The SP parliamentary group will change its composition in this parliamentary session. Arben Ahmetaj is expected to lose the mandate of the deputy, won in the elections of April 25, 2021, since he has not appeared in the Assembly in the last 6 months due to the conditions of the fugitive.
The session of July 6 was the last one when Ahmetaj entered the Parliament of Albania.
According to the constitutional provisions, this Saturday, January 6, is the last day that Ahmetaj can enjoy the mandate of the deputy of the Parliament of Albania, and then the declaration of the invalidity of his mandate is expected.
The reason for the end of the mandate is found in Article 71 of the Constitution, where in the letter "d" it is defined that "The mandate of the deputy ends or is invalid when he is absent without reason for more than 6 consecutive months in the Assembly".
After January 6, the Assembly will have to announce the vacancy created by the loss of the deputy's mandate by Arben Ahmetaj and officially notify the CEC about the filling.
The Electoral Code stipulates that the CEC fills the vacancy created with the next candidate in the multi-name list of the same political entity for the same electoral district. According to the ranking of the SP candidates for Tirana District, the mandate of Ahmetaj will have to be taken by Dallándyshe Bici, who won 4977 votes from the preferential vote and was ranked 21st in the list of SP candidates for Tirana.
In the event that Bici will refuse to take the mandate, as is rumored, then the CEC will have to notify the next candidate, Plarent Ndreca.
On July 14, the Assembly voted to authorize SPAK to arrest deputy Arben Ahmetaj after he was accused of corruption in the incendiary case.
But SPAK, after receiving the authorization, failed to stop MP Ahmetaj, who, as it became public, had left Albania. SPAK has announced an international search.
