The agreement signed between the Albanian and Italian governments for the reception of about 36,000 immigrants in two camps that are expected to be built in Shengjin and Gjadër , seems to be still in danger even though it has been approved by the legislators in Tirana and Rome .

The protocol signed by Giorgia Meloni and Edi Rama provides that for migrants rescued in the Mediterranean by Italian military ships, expedited border procedures will be applied, including the payment of a 5,000 euro guarantee, to await the decision of the asylum request in freedom and not in detention in the Albanian centers.

Precisely, the practice of accelerated border procedures led the judges of the immigration sections of the Italian courts not to act, but to ask the European Court of Justice to give the final word on its legitimacy.

The Court of Cassation in Italy returned the case to the judges of Strasbourg, while the Ministry of the Interior requested an urgent review of the appeal.

The European Court has answered "no", so the first effect of the Strasbourg decision may be that of a temporary postponement with an indefinite period for the implementation of the bilateral agreement.

In particular, the Court of Cassation requested an answer regarding the directive " 2013/33/EU " of the Parliament and of the European Council, which contains rules regarding the reception of applicants for international protection.

The Strasbourg Court had to clarify whether this directive excludes "a regulation of domestic law which provides as an alternative measure to the detention of the applicant, the granting of a financial guarantee, the amount of which is defined as a fixed amount and not a variable amount , without even allowing the possibility for the asylum seeker to establish the guarantee himself through the intervention of third parties, although in the framework of forms of family solidarity, thus applying methods that may prevent the use of the alternative measure by those who do so".

"For the Court of Justice, it is not a case that should be handled by urgent procedure, but that should be handled by ordinary procedure," said the lawyer Rosa Emanuela Lo Faro, who defends immigrants in two cases sent to the Court, to the Italian media. European Court of Justice.

"Two visions of the issue which differ between the two highest bodies, one national and the other European", she adds.
