The President of the Constitutional Court, Holta Zaçaj, said a few days ago that the non-implementation of the decision on the mandate of the former Foreign Minister Olta Xhaçka (currently MP) is an unusual situation and impossible to happen in a democratic state.
Among other things, in an interview for Voice of America, Zaçaj stressed that every decision of the Constitutional Court must be implemented.
Bledi Çuçi's response, placing the blame on the opposition's protest
The head of the Parliamentary Group of the SP, Bledi Çuçi, in a statement to the media, stated that it is not true that the decision of the Constitutional Court regarding the mandate of Olta Xhaçka has not been implemented.
Bledi Çuçi said that the Council of Mandates has not been convened due to opposition protests.
"4 months have been smoke and flames, if the Council of Mandates and Regulations met, they would say they took it unilaterally", said Çuçi, warning that there will be a decision very soon.
How will the Socialist Party vote on the decision to remove Olta Xhaçka's mandate?
Bledi Çuçi : You will see it when the Council of Mandates meets.
The decision of the Constitutional Court on the mandate of Olta Xhaçka
We recall that the Constitutional Court in January 2023 annulled as unconstitutional the decision of the Assembly to block the sending for interpretation to this court of Xhaçka's mandate, after her husband was declared a "strategic investor" and benefited, among other things, through a government decision, from the use of the coasts of the sea.
Mandate in the office of the speaker of the parliament
The issue of Xhaçka's mandate is held in the office of Nikola, who has the legal authority to decide on the further parliamentary procedure that will follow the implementation of the decision of the Constitutional Court.
The Council of Legislation through the majority approved a report where it suggested the return of the issue to the Council for Regulation and Mandates, while the opposition suggested following the previous parliamentary practice to send directly to the session for voting the opposition's request that Xhačka's mandate go for interpretation in the Constitution.
Despite the claims coming from the Assembly, it seems that this is an issue that depends on the political will of the majority, since Prime Minister Edi Rama called the decision of the Constitutional Court unclear.
SPAK and the husband as a strategic investor
Xhaçka's mandate has been called into question due to the benefit of her husband, Artan Gaçi, from the status of a strategic investor for a hotel in Dhërmi, as well as the permission to use the beaches in front of the hotel.
Meanwhile, SPAK has imposed a measure of preventive seizure on a land area of 5512 m2 owned by Gaç on the coast, as it is suspected that it was obtained through forged documents./ VoxNews
