Majko, retort with the head of SPAK: The Albanian public has expectations, your
Head of SPAK and Pandeli Majko

The head of SPAK Arben Kraja responded today in the Law Commission for the activity of the institution he leads.

While replying to the rapporteur of this session, the socialist MP Pandeli Majko, Kraja said that there was an investigative case by the SPAK for leaking investigative secrecy by the structures of the State Police and this case is already under trial.

He was also asked about the cases of non grata announcements and the position of SPAK but refused to answer, stating that he is not allowed to give opinions regarding decision-making of other bodies.

Kraja also focused on legal changes, emphasizing that two criminal offenses were added, which increased the work of SPAK prosecutors, but underlined that on the other hand, lowering the threshold of monetary amounts under investigation for corruption has brought a relief to them by focusing. at larger events.

The head of SPAK underlined that there is a need to increase even more the ceiling of the monetary amount investigated for corruption in order for special prosecutors to investigate large amounts related to violations in public procurement, this various officials consume elements of criminal offenses violation of equality in tenders. On the other hand, the socialist Pandeli Majko at the end of his speech stressed that the battle of SPAK is neither with the majority nor with the opposition but with the expectations of the citizens for their work.

Excerpts from replicas

Pandeli Majko:  Equality before the law is the essence of what can be discussed as a relation. From the monitoring of the Assembly it is said that the SPAK has registered mainly 18 criminal proceedings and according to the Ministry of Justice this number remains low. The report does not say what were the indications for initiating these proceedings. The report does not clarify the status of international obligations regarding the point of explanation or EU recommendation for Albania. The report does not have complete information on BKH issues.

These and elements of other natures will be elements of questions from colleagues. I also handed over the document to the head of SPAK. How many of these investigations are for corruption and how many are for organized crime? How do you assess the requests of partners to address high-level corruption? Do you see these as a call for more action from ae SPAK? What are the measures you took when you had a leak of investigative secrecy or when the accused persons left the country? How did the SPAK assess from the point of view of legal competencies the decision to declare non grata against a senior official. Do you see this as a clue or cause for proactivity? Do you have mechanisms for cooperation and coordination with HIDAA? Do you think you need other legal changes to ease the burden? I believe that you are aware that you have only one opponent and that is not the majority or politics but the expectations of the Albanian public

Arben Kraja:  How much they are for corruption and how much they are for organized crime are detailed in the table. It is a provision that says that public servants are obliged to file a report when they find elements of a criminal offense. A single structure cannot be required to do everything. We must all do our part together.

We value every opinion of the partners to build our work in the sense of priorities. The code of criminal procedure on which we operate obliges the exercise of criminal prosecution in every case. It does not allow the prosecutor to choose. For every report that comes, the prosecutor is obliged to continue criminal prosecution. A prosecutor cannot be told what to investigate. Priorities are also related to the load. We have issues that you know very well with 20 or 30 detainees. It is very complex. The leak of investigative secrecy is not within the competence of the SPAK. We have not had a concrete investigation except for one case of leakage of investigative secrecy from the state police structures that we have investigated and is on trial today.

I can not give an answer to non women because by law we are forbidden to give opinions. We have had good collaborations with other institutions. We made arrangements to have contact points not to simply work with letters. We have added work with legal changes. Two criminal offenses have been added to us. Some of those who were considered petty corruption were removed and in this respect our work was facilitated. In the area of public procurement there is a need for revaluation to increase the amount where SPAK should be included. For the offense of violation of equality for participation in tenders. For us to focus on great values. In this regard it needs to be revisited. We have requested some legal changes appreciating the activity we have done so far. SPAK prosecutors should have a structure of legal assistants.
