Not a single lek since the arrest, the Municipality of Tirana seeks opinion:
Erion Veliaj

Should Veliaj receive his salary? This is the question that has recently been addressed to the CEC and two ministries, the Finance and Justice ministries.

Specifically, the acting mayor of Tirana, Anuela Riastani, has addressed the Central Election Commission, the Ministry of Finance and the Ministry of Justice to request a legal interpretation regarding the right of Mayor Erion Veliaj to receive a salary, while he has been under the security measure of "prison arrest" since February 11.

According to the official letter, as of this date, the Municipality of Tirana has not made any monthly payments to the mayor.

The document emphasizes that, despite the coercive measure, Erion Veliaj continues to hold the position of Mayor of Tirana, following the decision of the Constitutional Court dated November 3, 2025, which annulled the decision of the Council of Ministers to dismiss him from office, considering it contrary to the Constitution.

The Municipality of Tirana clarifies that the procedure for paying salaries to local administration employees is implemented based on Instruction No. 30, dated December 27, 2011, “On the management of assets in public sector units”. This instruction stipulates that the right to salary, even in cases where the employee does not perform his/her duties for reasons not attributable to him/her, must be proven by legal and sub-legal documents in force.

"The data to determine the employee's right to salary, when he does not work due to an interruption in work through no fault of his own, ordinary leave, participation in training courses, temporary incapacity for work, for performing other state or social duties, are certified by documents approved by other legal and sub-legal acts in force...", the document states.

Not a single lek since the arrest, the Municipality of Tirana seeks opinion:

Given that the situation of the elected mayor is unusual and creates uncertainty in the implementation of this instruction, the Municipality of Tirana requests from the competent institutions clear guidance on the interpretation of point 71 of the instruction, specifically on the legal and sub-legal acts that determine the right of a locally elected official to receive a salary under such conditions.

At the end of the letter, the Municipality states that it awaits the official interpretation of the relevant institutions, in order to orient its actions in accordance with the legislation in force.
