The chairman of the " ad hoc " anti-corruption commission, Fatmir Xhafaj, confirms that the Law Reform approved in 2016 with full consensus will be changed and at the same time leaves open the impact of the fundamental law of the state.
But he does not see as a rejection the response of independent institutions, not to participate with experts during the discussion of justice reform.
In a press conference with journalists, he said that these institutions have left the task of carrying out the process to the Assembly.
He said that the Assembly will consult with independent institutions when the drafts are drawn up.
"We told the justice institutions to do the process. They told us that the Assembly should do it. They will be involved in this process with the proposals they have, with their documents. We have started reviewing the reports and debates in the session to see the issues raised by the justice institutions. They will be part of the working group table, but the moment the draft comes out, they will be consulted. The system is not the leaders, they are temporary. We will tell the judges and prosecutors what your positions are ", said Xhafaj.
The head of the special commission said that so far the experts have not proposed constitutional changes, but he expressed his openness during the discussion.
"As far as I can see, there are none, but the consultation may bring out the need for changes. From the current draft, I do not see any proposals for constitutional changes. I see the need for legal and institutional changes. This is a process, there can be proposals during the debate, and it can be achieved that there are also such. There are no restrictions even for a special commission", continued Xhafaj.
At the same time, he announced that SPAK has requested the amendment of its organic law.
"As for constitutional changes for justice, there are none. If they ask for it, yes. SPAK has asked itself to change its law for some requests that they have. The justice institutions themselves have requested 120 changes".
