California sues Trump over tariffs: They are illegal and cause damage
Donald Trump

We may not be on the verge of the “Republic of California” secession yet, but the richest and most populous state in the US has also become the first to challenge Trump on tariffs. Governor Gavin Newsom and Attorney General Rob Bonta filed a lawsuit yesterday in the US District Court for the Northern District, arguing that the White House chief lacked the authority to impose the tariffs. They therefore asked the judges to block them immediately, because they are already causing great and irreparable damage. So it is a direct attack on the entire tariff strategy, which if successful would ban them across the country, while also helping the various countries affected. A challenge within the challenge, because California is the most powerful liberal state, along with New York, and Newsom does not hide his ambition to aim for the White House in 2028.

“Donald Trump,” the governor wrote in X, “does not have the authority to unilaterally impose the largest tax increase of our era with his devastating tariffs. We will take him to court.” He then added: “President Trump’s illegal tariffs are wreaking havoc on California families, businesses, and our economy, driving up prices and putting jobs at risk. We are standing up for American families who cannot allow this chaos to continue.” Attorney General Bonta then explained the action thus: “The President’s chaotic and haphazard implementation of tariffs is not only deeply troubling, but also illegal. As the fifth largest economy in the world, California understands that global trade policy is not just a game.”

The lawsuit argues that Trump cannot use the Emergency Economic Powers Act of 1977 to impose tariffs, based on the claim that Fentanyl trafficking from China or the trade deficit pose a threat to national security. The Constitution clearly gives Congress the authority to impose tariffs, and yet the law used by the White House does not include them among the measures the president can take in an emergency. Therefore, the practice followed is illegal and must stop immediately, because it is already causing harm.

The White House, through spokesman Kush Desai, responded: “Instead of focusing on rampant crime, homelessness, and economic deprivation in California, Gavin Newsom is spending his time trying to block President Trump’s historic efforts to finally address the national emergency that our country’s persistent trade deficit represents. The entire administration remains committed to addressing this emergency that is destroying American industries and abandoning our workers, through every means at our disposal, from tariffs to negotiations.”

California, if it were independent, would be part of the G7. This helps to understand its fundamental weight in the American economy, from Silicon Valley to wine, from agriculture to defense and space companies, not to mention Elon Musk's Tesla, which, due to political resentment, has moved factories to Texas, but has been forced to leave research where it was. Since the days of Haight-Ashbury and the "Summer of Love", it is also one of the most liberal states, perhaps with New York and Massachusetts, and affected by phenomena such as climate change. It is therefore more at odds culturally and politically with Trump and the part of America that supports him.

In practical terms, Mexico, Canada and China are California's three main trading partners, with the state exporting $183 billion worth of goods and importing $491 billion last year. Even Italy pales in comparison. The tariffs are already wreaking havoc on the local economy and are making it harder for Los Angeles to rebuild after the January fires that destroyed entire neighborhoods like Pacific Palisades and Altadena, costing at least $2 billion. A disaster, then, that adds to the losses in key sectors like tourism.

Newsom has tried in recent months to reposition himself with more moderate choices, for example on the participation of transgender people in women's sports competitions, and has also been in dialogue with former Trump advisor Steve Bannon, because he thinks that this will make him more popular in 2028. But he has decided not to give in to the tariffs, not only because of the damage they are causing to California and all of America, but also because they are an economic mistake that could greatly weaken Trump among voters. That is why California has decided to become the flag bearer of resistance./La Repubblica
