International judges largely paved the way for the main court proceedings against Russia. The decision in favor of Ukraine would have great symbolic value, but the court has no instruments to implement the decisions.
The International Court of Justice in The Hague has largely accepted the handling of Ukraine's indictment against Russia submitted to the court shortly after the start of Russian aggression in Ukraine in February 2022. The court has largely rejected a claim by Moscow that the court has no jurisdiction over such matters. On the other hand, the judges did not accept an accusation by Ukraine, that Russia with its attack violates the UN convention on genocide, because at this point the court does not consider itself responsible.
Russian President Putin justified the march of his soldiers into Ukraine with the argument that the Russian population in eastern Ukraine is exposed to "mistreatment and a genocide by the Kiev regime." A little later, Ukraine submitted the indictment against Russia to the International Court of Justice, where it "strongly" rejects this charge, and asks the court to prove that Kiev did not plan and commit genocide. The fact that Russia uses the accusation of genocide as a pretext is a violation of the UN convention of 1958, says the Ukrainian side.

Ukraine is supported by 32 Western allies
As early as March 2022, the International Court of Justice asked Russia in an interim decision to immediately stop the occupation. But the "armed conflict" continues until now, the court declared. Friday's decision (02.02) opens the way for the main procedure, which can last three years. Ukraine is supported in the International Court by 32 Western allies, among them Germany.
According to experts, a binding decision in favor of Ukraine would have a high symbolic value. However, the UN International Court of Justice has no means of forcing states to implement its decisions. Two days ago, the International Court of Justice did not accept in many points an accusation of Kiev against Moscow, freeing Russia from the accusation that it has financed terrorism in the east of Ukraine, thereby violating the obligations of international law. The court argued that the international agreement to combat the financing of terrorism only covers cash transfers and arms supplies. Ukraine's claims against Russia for arms supplies to certain groups in Ukraine are thus not covered by the convention. DW
