Kosovo Justice Minister Donika Gërvalla denied that she had cooperated with the Kosovo Specialist Chambers and said that such statements have now become “blatant.” She said that since the day of the verdict against the Kosovo Liberation Army four, she has been working on the next instance, that of appealing the decision.
At a press conference in Pristina on September 26, Gërvalla also rejected criticism that he had remained silent on the war crimes conviction of four KLA members.
"The statements that link me in any way to the collaboration have already become a lie because I have explained them several times. There is no connection, either directly or indirectly, with UNMIK, EULEX, or the Special Court. But we must have a little patience because the verdict will come soon and we will see it very soon ," said Gërvalla.
The Kosovo Liberation Army Veterans Organization on September 18th articulated a request to the Government led by Albin Kurti to dismiss Gërvalla, amid criticism for its failure to make a statement regarding the verdict.
The head of this organization, Hysni Gucati, during a protest held that same day said that "we know that Gërvalla has submitted documentation to The Hague", adding that Prime Minister Albin Kurti "must remove people like her from the Government from today."
The accusations that Gërvalla collaborated with Speciale are long-standing, and she has denied them several times.
"I have not been silent, I am the Minister of Justice. The Prime Minister has issued a statement on behalf of the Government, while I, together with my team, have been working since day one in order to prepare for a battle because the issue of the Special Court is a legal battle, it is not a battle of statements in the media. And, as a legal battle, we must be professional, smart, with a cool head, without too much shouting, we must prepare for the next instance ," said Gërvalla.
Regarding the call for her resignation or dismissal, Gërvalla said that every citizen can request the resignation of any minister, as Kosovo is a democratic country.
Regarding the ongoing protests against the Specialist Chambers' decision, Gërvalla said that apart from a "disappointment" on the first day of the protests, on September 16, they are now "dignified" and being carried by citizens. However, she said that she sees it more appropriate to work on the issue of appealing the decision than to participate in the protest.
Former KLA leaders Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi were convicted of war crimes in the first instance of the justice mechanism in The Hague, also known as the Special Court. The defense has launched appeal proceedings against the verdict, which sentenced the four to 81 years in prison, taken together.
Since then, protests against the decision have been continuously held in Kosovo, but also in other European countries.
The Democratic Party of Kosovo has initiated a draft law in the Assembly to amend the law on Special, which has been processed in the Government for opinion.
Gërvalla said that the team of experts at the Ministry of Justice is working to provide an opinion on this issue.
"When we have it ready, we will send our opinion to the Government. We will not delay it, we will send it quickly. But we also do not want to rush and pay for it with missing quality and unacceptable mistakes. More than words, we need cooperation and coordination, analysis and expertise so that justice prevails in the end ," said the minister.
According to her, it is being analyzed which proposed mechanisms are "functional, and which are experimental", adding that the Ministry of Justice is working intensively on this issue.
The document of amendments proposed by the PDK, which Radio Free Europe has seen, requests, among other things, that the highest sentences that can be imposed by the Court in The Hague be 15 years in prison and that those convicted be subject to presidential pardon.
The initiative is supported by the Alliance, while the ruling Vetëvendosje Movement has said that it will analyze it from a legal perspective, including its compatibility with the legal framework in force and "the effects that such an intervention could eventually have at this stage of the proceedings before the Specialized Chambers."
The Kosovo government has pledged to engage in the appeal phase to, as Prime Minister Kurti has said, "correct" the decision, considered unfair, against the KLA foursome./ REL
