Supreme Court requests 84 additional judges: We have the files in stock

The High Judicial Council has proposed increasing the number of judges in the country to help reduce the backlog of cases.

Of the 417 judges who are on the staff, although 309 are effectively on the job due to vacancies, the Supreme Court of Justice proposes a total number of 528 judges, distributed among permanent, reserve and temporary.

The Supreme Court of Justice proposes that 84 permanent judges be added to the national body, to be distributed among the courts of first instance and those of appeal.

The largest number is expected to be received by the first instance of the judiciary, with 64 judges with special attention to general jurisdiction in Tirana and the Administrative Courts, which are being increased by 18 judges each, writes Shqiptarja.

"44 of them should go to general jurisdiction, specifically 18 in Tirana, 6 in Durrës, 5 in Elbasan, 6 in Fier, 3 in Korça, 3 in Shkodra and 3 in Vlora. For administrative jurisdiction, an increase of 18 seats is proposed, where 16 are assigned to the Administrative Court of First Instance in Tirana and 2 to the Administrative Court of First Instance in Lushnje. While an increase of 2 seats is proposed in the Special Court of First Instance for Corruption and Organized Crime," the document states.

According to the plan, 20 seats will be added to the Courts of Appeal, 6 of which will go to the Court of Appeal of General Jurisdiction, 12 to the Administrative Court of Appeal and 2 to the second instance of the GJKKO.

But the KLGJ also has a plan for reserve staff. In addition to the 84 permanent operational positions, it is also proposed to create 18 other permanent functional reserve positions. These judges will be appointed and ready to compensate for vacancies that remain in the system when judges are engaged for long periods in other institutions, such as in the case of members of the KLGJ, the Constitutional Court or other institutions. This would help ensure that the court of origin is not left with empty positions.

With the implementation of these two additions, the number of permanent judge positions is expected to increase from 417 to 519, while for a period of only 9 years, an additional 9 judges are also expected in the High Court, to deal with the large number of backlogged files.

"The study highlights the need for an additional capacity of 9 judges in the High Court, for a single, non-renewable mandate and linked to the handling of a defined category of cases. This measure aims to contribute to the reduction of the accumulated stock in this court," the document proposing the draft decision states.

In addition to significantly increasing the total number of judges in the country, the Supreme Court also has a concrete proposal for increasing the judicial administration that would serve it.

"A minimum planning of 336 non-judicial employees is proposed for the 102 permanent positions, as well as 56 employees for the temporary package of 9 judges in the High Court. The study also emphasizes that the addition of new positions should be accompanied by the provision of the necessary construction and technological infrastructure necessary for the effective functioning of the courts. For this purpose, the drafting of a special investment plan is recommended," the document states.
