In a meeting at the beginning of March 2022, among the decisions taken by the Government was the one for giving a property in a wide area of the beach of Gjileka to an American company for use for 30 years.

The decision followed an earlier act of the Strategic Investments Commission, which had announced this strategic investment.

The project was a hotel, which according to the provisions of the law on strategic investors must be five stars. For its implementation, the company "AGTCC Hotel Management" was assigned, which in the national business register was owned by Tawni Lin Grzych-Sutton, a 30-year-old citizen from Massachusetts, USA, with a residence permit in Albania.

The media revealed at the time that the American company lacks data and other documentation to prove that the 30-year-old's company and the 30-year-old herself have the experience and financial resources necessary to benefit from the status of a strategic investor.

Faced with these publications, Artan Gacci admitted that he and his company, AGTTC, were behind the strategic investment, while the American company surprisingly named 'AGTCC Hotel Management' was selected by him to implement the project.

Gaçi said that he would make the investment, while the American company would implement and manage it. This, according to him, avoided the conflict of interest law.

But the suspicions of conflict of interest were not the only ones. Sicc are shown in the SPAK file, part of the properties secured by Artan Gacci to implement his strategic investor project have been benefited by forgeries in at least two cases and for which Jorgo Goro has been arrested.

Specifically, according to SPAK, in the first case, Jorgo Goro falsified the documents and then registered 5512 m2 of state land in favor of private individuals.

In the capacity of the mayor of Himara, Jorgo Goro, in cooperation with his subordinate, Jerasmo Bashin, at that time director of Land Protection and Management in the municipality of Himara, without making any verification based on the law, forwarded documents to the competent bodies completely falsified, making it possible to then register an area of 5512 m2 of agricultural land owned by the state, in favor of the private entity.

According to SPAK, this alienation was unfairly benefited by Stavri Mëhilli. Currently, this area of agricultural land is sequestered by GJKKO.

In the second case, SPAK says that Jorgo Goro transferred the agricultural land of 5080m to the state, where permission was then given for the construction of the tourist complex of Artan Gaç.

According to the Special Prosecutor's Office, in the capacity of the mayor, Jorgo Goro, in cooperation with Jerasimo Bashi, director of Land Protection and Management in the municipality of Himarë, has actually moved an area of agricultural land of 5080 m2 to the ground, giving superimposed on it another property owned by the state.

Shadows of a contested law

The Law on Strategic Investments was passed in 2015 as a temporary law to provide equal protection to both domestic and foreign investors. The idea was that the law would remain in force until the new investment law was completed...which after almost 10 years has not yet been completed.

Strategic investor status is awarded in six sectors; energy and mining, transport, electronic communications and urban waste, tourism, agriculture, technology and economic development areas and priority development areas, mainly coastal ones.

So far, more than half of the strategic investors have benefited from this status in the tourism sector, mainly in contested projects for the construction of tourist complexes and resorts on the coast.

Assistance has been offered to these investments in speeding up the procedures, equipping them with the necessary permits and licenses for the realization of the investment, making available the state properties of the sea coast or forest areas near the resort, the construction of auxiliary infrastructure such as: roads, electrical network , water supply, sewerage and assistance for land consolidation, which includes the registration of properties in the ZVRPP or taking into use for a long period with a symbolic fee of state properties according to the investor's request.

In relation to this law, there has been criticism that it is being used by people close to the government to acquire state and private property in the most coveted coastal areas, while remarks have also been made in one of its provisions, where the state can take private property citizens to put them at the service of the strategic investor.

The law states in its article 28 that "to enable the development and realization of strategic investment projects, which have benefited from the status of "Strategic investment, special procedure", the expropriation of private real estate is allowed, if the investor has not been able to resolve ownership of the real estate by agreement with the owner, after efforts have been made by the investor.
