The Albanian Investment Corporation will be able to manage all public properties that are transferred to it, giving them for use to private entities through several forms, such as rent, leasing, sale or the creation of a public-private partnership.

Referring to the decision published in the Official Gazette, the corporation uses the properties owned/used by it, in function of an investment project conceived or designed by it alone or in cooperation with public or private partners or an investment project conceived and proposed by private partners or public in the case when these projects have the status of strategic investment, investments with a special status in a certain sector or in cases where the property is located in priority areas for development.

But what are the basic criteria and who benefits from the use of public properties? An entity must meet the legal, technical and financial criteria. Basic legal criteria include that the entity is not subject to bankruptcy proceedings; not to have been convicted by a final court decision for offenses related to professional activity, to have paid tax obligations and contributions in accordance with Albanian legislation or applicable provisions in the country of origin.

Regarding the financial criterion, the subjects must submit three years' balances; to have the financial capacity to finance the architectural project and to cover the costs of development/improvement of the property in the case of entrepreneurship to have a bank guarantee, the minimum for the necessary financial capital in the case of enphyteosis and entrepreneurship.

Also, the state property owned by the Corporation can be sold or used as a guarantee, collateral, pledge or mortgage by decision of the Supervisory Council, a process that can be done through a public competition procedure through dynamic selection/envelope or scoring.
