The contingent liabilities of the Albanian state, as a result of the decisions of the Arbitration Courts or the legal costs of defense in them, reached at the end of 2022 almost 174 million euros.

This means that these obligations are known and the Albanian state must start paying. Only during the past year, 7.8 million euros were paid for arbitrations, where most of them are administrative costs, while together with some other known obligations, also related to negotiations, this cost is 940 million alleks or 8.5 million euros.

The Ministry of Finance, in the actual budget of the previous year, reports that the available data are from May 2023.

"The information is based on the latest data (May 2023) reported to the MFE by the State Bar and Line Ministries/Budgetary Institutions. Consequently, our estimates are accurate to the extent of the information available to us. Only the State Bar has the right to validate them," the government document clarifies.

However, the Ministry has made a list of all cases in arbitrations for which payments were made during the past year.

In 2022, the total value of legal costs, representation, defense, court costs or other costs related to international arbitration decisions, paid by the state budget, amounted to 940.25 million ALL. From these:

- Around 198 million Lek Ministry of Finance and Economy, for the payment of preliminary costs, legal services and other legal costs for the representation and defense of the Republic of Albania in international arbitration decisions.

- Around ALL 79.2 million to the Ministry of Tourism and Environment, for the payment of legal services related to the process of canceling an international arbitration decision.

- About ALL 81.4 million to the Ministry of Agriculture and Rural Development, for the payment of legal and administrative costs of the Court related to an international arbitration decision.

- Around 155 million ALL from the Ministry of Infrastructure and Energy, for the payment of legal costs for representation and defense, as well as for the payment of legal costs in procedures for annulment of international arbitration decisions.

– About 126.7 million ALL to the National Water, Sewerage and Waste Infrastructure Agency (AKUM), for the payment of legal costs for consultancy services, legal services for representation and defense in international arbitration matters.

- About ALL 11.4 million to the Albanian Road Authority, for the payment of legal services for representation in the procedures for annulment of an international arbitration decision.

- About ALL 63.5 million to Albpetrol Sh.a, for the payment of court expenses, administrative/legal costs for representation and defense in international arbitration matters.

- About ALL 140.1 million to Albpetrol Sh.a, for the payment of court expenses, administrative/legal costs for representation and defense in international arbitration matters.

- About 31.75 million lek National Agency of Natural Resources, for the payment of legal costs for representation and defense in international arbitration matters.

- About 116.7 million ALL to the Durrës Port Authority, for legal and financial consultancy as well as administrative and legal costs for international arbitration issues
