SPAK's explanations for not touching Berisha insult the official positions

The current head of SPAK, Arben Kraja, has tried to keep a distance from what he calls international interference in SPAK's investigation agenda, in order to justify the non-investigation of Sali Berisha. In his interview today, Mr. Kraja emphasizes the independence of prosecutors in the scope of their work and in the same context says that he has not received instructions from the international authorities for investigations.

There is room for two clarifications here.

First, SPAK cannot receive instructions either from foreigners or from Albanians, as we know that it is an independent institution, but it is an investigative institution set up in the framework of the reform of justice, for which the Constitution of the Republic has been modified of Albania and the USA and the European Union have been allowed to supervise and approve some links of justice.

For this reason, the positions and recommendations of the USA and the EU towards justice reform and the investigation agenda are not interference, but their obligation. The USA has declared that the judicial reform in Albania is a national interest of the USA.

The second, which is related to the first point, is that the highest official authorities in the US, including special US officials who deal with Albania, such as Mr. Escobar, have directly asked the Albanian judiciary to investigate Sali Berisha as a declared person from the USA person "non grata" for major corruption, together with family members, as an underminer of democracy and a blackmailer of the justice system. This is the official definition in the design of the Secretary of State for Sali Berisha and his corrupt family.

SPAK, which also undertakes investigations based on information from the daily press, has not seen fit to consider the design of Sali Berisha, Liri Berisha, Argita Berisha and Shkëlzen Berisha as corrupt due to the use of power and at least were subjected to the property investigation, as was done with Ylli Ndroqi or former chief prosecutor Adriatik Llala, who were declared "non grata".

So there is no need for the US or the EU to interfere in the Prosecutor's Office and they do not have interference in their culture. They have made Berisha and his family public as the object of investigation and have officially requested that he be investigated.

The insult that exponents of the investigation in Albania try to make to the "non grata" design institution with the banal reasoning that they "want facts" is even more serious, since the investigation is started to find facts and no facts are expected to start the investigation.

Even more serious is the situation when another western country with an impeccable reputation in justice, such as Great Britain, has declared Sali Berisha a "non grata" person for his criminal connections in politics, in a detailed letter with accusations of and about 14 of his criminal associates.

Again there is no investigation process initiated against him. I'm not talking about getting a defendant or being found guilty, but starting an investigation. The two largest and most serious countries in the world, the two most certified impartial justices in the world, have declared him a thief and a man with criminal connections.

I don't know what index for investigation the Albanian justice is looking for. It is about a man who killed in the middle of the boulevard, he glorified himself for killing, and to this day, no prosecutor has interrogated him for information and asked him: "Oh, why did you kill?".

And even worse, I don't know why they continue to insult and humiliate the West worse than Sali Berisha, using his rhetoric of "facts" that someone should bring to them. Are you saying that the people we have in charge of the investigation are directors of archives and not prosecutors?

The West does not release instructions for investigations. The West has investigated and punished Sali Berisha. The US has officially requested that its standard of investigation against Sali Berisha be respected. SPAK has not done it. Others are flimsy excuses. Berisha has better excuses than SPAK itself for not touching him.
