The Prosecutor's Office of Tirana has provided details from the talks with the Spanish authorities regarding the case of 33-year-old Saimir Sula, who died in a hospital in Barcelona.

According to the Prosecutor's Office, the Spanish side clarified that " due to the opening of the case in Spain by the family members of the deceased, as well as in the conditions where the case is currently being examined in the Supreme Court, the decision is expected from this court and then to proceed with sending the heart to Albania".

Meanwhile, it is reported that the performance of the DNA test of the heart will be decided by the Spanish court, which is currently under review.

At any moment at the end of the processes in Spain, the heart will be sent to Albania.

Information about the case of the SS citizen who died in Spain 2020

The Prosecutor's Office at the Tirana Judicial District Court informs about the meeting held in the premises of the Barcelona Prosecutor's Office, in the Directorate of International Judicial Cooperation for the case of the deceased, SS

The meeting was attended by Mónica Marcos, Prosecutor at the Department of International Relations, Sonia Canal, Prosecutor of the case, as well as Mrs. Suela Salavaci Prosecutor of the case at the Prosecutor's Office of the Judicial District of Tirana and representative of the Ministry of Justice.

In the meeting dated 08.02.2023, the issues previously presented to the Spanish side electronically on 06.02.2023 were discussed, regarding the following:

- The progress of the execution of the second letter of the Tirana Judicial District Prosecutor's Office sent in April 2022

The Spanish side informed the Prosecutor Ms. Salavaci, that they have examined the information of this request and very soon it will be forwarded to the Albanian authorities, as it is being finalized.

- Sending the heart of the deceased SS to the Albanian authorities to carry out the DNA analysis

The Spanish side clarified that due to the opening of the case in Spain by the family members of the deceased, as well as in the conditions where the case is currently being examined in the Supreme Court, the decision is expected from this court and then the sending will proceed of the heart in Albania.

–  Kryerjen e testit të ADN-së

Në kushte kur ekzekutimi i letërporosisë është në proces, kryerja e testit do të vendoset nga gjykata spanjolle e cila aktualisht e ka në shqyrtim, por në çdo moment në përfundim të proceseve në Spanjë, zemra do të dërgohet në Shqipëri.

–  Mospërputhjen e datave e pretenduar nga motra e të ndjerit se studimi histopatologjik i zemrës së shtetasit S.S., është bërë me datë 22.04.2020, (ndërkohë që ky shtetas ka ndërruar jetë në datë 09.05.2020).

Në lidhje me këtë pretendim, nga pala spanjolle u sqarua se ky është një gabim material i shkruar, pasi studimi hispatologjik ka filluar më datë 22.05.2020, kjo edhe për faktin se datat e referuara në brendësi të vendimit provojnë se është një gabim material i shkruar.

Pala shqiptare, prokurori i çështjes, Zj. Salavaci, kërkoi informacion mbi:

Parashikimet e legjislacionit procedural spanjoll në lidhje me ruajtjen e materialit gjenetik apo organit mbi të cilin kryhet dhe çdo analizë shkencore. Prokurori spanjoll informoi se sipas procedurës penale spanjolle, organi(zemra) asgjësohet pas përfundimit të procesit.

Në lidhje me rastin konkret, prokurori shqiptar kërkoi garanci për ruajtjen e organit (zemra) dhe prokurori spanjoll vuri në dispozicion kopje të vendimit të Gjykatës së Barcelonës datë 25.08.2021, përcjellë urgjent në Institutin Kombëtar të Toksikologjisë dhe Mjekësisë Ligjore në Barcelone, ku ishte disponuar mosasgjësimi i organit (zemrës) së të ndjerit S.S., nga Instituti i Mjekësisë Ligjore.

The Albanian side brought to the attention of the Spanish authorities the sensitivity that this issue had received in Albania, including the media and relevant institutions. Albanian authorities are fully committed to resolving the issue. For the above, we requested direct communication between the prosecutor's offices to exchange information in time.
