Journalist Eni Ferhati was invited to the show "The Unexposed" where he spoke about the investigations against former minister Ilir Beqaj, which led to a clash between judge Erion Bani and prosecutors Kondili and Nakuçi.
The judge recommended that Beqaj be sentenced to "prison detention" and that one more charge be added to what the two prosecutors have done.
Ferhati said that this clash actually happened within SPAK and that Altin Dumani asked the prosecutor Kondili to deepen the investigation.
"The judge took care to underline that the court cannot give a higher measure than what the prosecutor requests. We are familiar with the judge's decision. What has happened is this, a second amnesty for Mr. Beqaj. An operation was performed in August, where Mr. Beqaj's name did not appear anywhere, but only the deputy minister. This is where the first amnesty started. The court said there is room to prosecute Ilir Beqaj, Shkëlqim Cani and a number of other officials.
We come to the last moment, the court suggests, because it has no right to order. The judge of the preliminary session can return the file. Judge Bani says that Mr. Beqaj should also be charged with forgery of documents, seals and stamps. Beqaj as the holder, it is suspected that during the negotiation of the contract he changed the data of the contract, burdening the position of the state, causing the obligations related to energy, water, facilities, to be taken over by the state.
In short, the court said, Beqaj should be in prison, but I have nothing to do.
This is a hot potato. There was not only a clash between the court and the prosecutors, but there was also a reaction from the head of SPAK, Mr. Altin Dumani, who apparently did not agree with this decision of the two prosecutors Kondili and Nakuçi.
There was also an initiative by the head of SPAK, who used the non-binding recommendation telling subordinates that this file has problems. It was a forgotten file and apparently it was not properly investigated," said journalist Ferhati.
While the journalist Artan Hoxha said that the case is still under investigation and until it goes to the basic court we don't know what charges could be brought against Beqaj.
According to him, the judge can give the arrest in prison if the prosecutor requested, adding that at this moment in the case Rama cannot defend him.
"The security measure is a measure that is taken at a certain moment when the case is under investigation and the case has not gone to the trial court and until it goes there we do not know what other charges will be added to Ilir Beqaj. In case the two prosecutors have committed a violation, it is the court of origin that forces the prosecutor to file this charge for x violation.
The judge is asking why he doesn't arrest him, while the prosecutors say that we don't see it as reasonable. At this moment, only the security measure is being discussed, it is the same as in the case of Berisha. When it goes to the trial, then we can judge whether the prosecution has done the investigations properly or not.
Today we are at the part where prison arrest is being insisted upon, but the judge can grant prison arrest if the prosecutor requested it, and this is the problem that we are dealing with technicalities and not the big problem. Rama cannot protect Ilir Beqaj at this moment because he will save him to the security measure, but what will he do later" , said Hoxha.
