The Albanian Committee of Helsinki informs that its observers have been prevented from verifying the suspicions about the death of Enver Sheshi in the detention rooms.
Through a long statement, the KSh lists all the abuses it says have been made to its observers by state institutions. The observers first appeared in prison 313, where the late Enver Sheshi, one of the accused in the case of the Fier incinerator, was kept in a cell.
With the claim that the case is being pursued by the prosecutor's office and everything related to this case is available to it, the head of the prison did not accept that the observers of the ASC were familiar with the relevant documentation of the admission of the deceased.
The committee says that the cooperation agreement it has with the General Directorate of Prisons was violated, where it was not accepted for the observers to have a meeting with the staff of the institution, nor to inspect the premises in which the detainee was accommodated.
The observers were then presented at the prosecutor's office in Tirana, where we were informed by the Coordinator for the Right to Information that there was no report registered on this matter.
On the second day of the verification, the Helsinki observers appeared in 4 different institutions of the State Police and after a long ordeal of visits and follow-up by these authorities, it was possible to make concrete that in the Commissariat no. 4, Tirana, the Judicial Police Officer had performed several procedural actions for this event.
He informed the observers that he went to the morgue and performed some procedural actions for the recording of evidence such as 'cadaver examination report; minutes for the performance of the medical-legal expertise, as well as the data obtained from the TIMS system for Enver Sheshin.
Helsinki says in a statement that the officer violated the Code of Criminal Procedure by not informing the prosecutor. He claims that he notified the prosecutor about these actions, but he did not make any concrete information available to the observers, who this prosecutor was and how he was notified by phone or by letter.
The relevant minutes have been sent to the Prosecutor's Office of Tirana for further procedural actions, but no criminal charges have been filed. The verbal request of the group of KSh observers to familiarize themselves with this documentation was not accepted by the Judicial Police officer, on the grounds that they were forwarded to the Prosecutor's Office.
Helsinki observers were also present at two other institutions such as QSUT and the Institute of Forensic Medicine. Near QSUT, after a long time of waiting, they were informed that they should make a request for information, while the representatives of Forensic Medicine were informed that the results of the autopsy had not yet been released.
Helsinki declares that the whole affair contradicts the decisions of the Strasbourg Court on the investigation of suspicious deaths, where the responsibility may lie with state institutions.
Helsinki says that this refusal creates reasonable suspicion that Enver Sheshi's basic human rights have been violated. The statement closes with a call to the Prosecutor's Office of Tirana to be transparent about the event.
