In the concession for sterilization, some changes were made only with the signature of Ilir Beqaj in the function of the Minister of Health and not with the proposal of the Commission for granting the Concession.

In the decision of the Special Anti-Corruption Court, the violations committed in the sterilization concession are listed, according to SPAK investigations.

In one of the violations, it is shown that the change made for hospital waste contradicts the feasibility study approved by the commission for granting the Concession and the public/private partnership, as well as the financial statements attached to this study.

"In the financial statements, the waste according to the following categories provided in the feasibility study, are included in the price for each surgical intervention according to the relevant intensity. Given these conditions, no reason has been given as to why these changes were made, at the initiative of the Contracting Authority or upon a request for clarification from any of the economic operators. Also, no change has been made in the feasibility study, financial statements or in the total value of the project, in relation to the prediction of the maximum service prices, since the costs predicted according to the above-mentioned categories of waste had to be removed with the change made. The Commission for granting the Concession for these changes does not appear to have drawn up any appendix in compliance with Article 21 of Law 125/2013 "On Concessions and Public Private Partnership", and Article 42 points 2 and 2/1 of Law No. 9643 dated 20.11.2006 "On public procurement", amended. This is due to the fact that in this particular case we are essentially dealing with a change in point 2.3 of Appendix no. 9 "Special qualification criteria" and point 6 of Appendix 13 "Terms of reference", which are part of the standard documents of the Concession and public/private partnership. Likewise, the amendment of the standard documents of the Concession and the public/private partnership has not been drafted and the amendment was proposed by the commission for granting the Concession, which also compiled the standard documents of the Concession. This change was made only by the Minister of Health zIB through letter No. 1440 Prot., dated 20.03.2015 and was ordered to be published by Order No. 124, dated 20.03.2015 to the Minister of Health Ilir Beqaj".

In the voluminous file disclosed by the editorial office of TCH Web, the Prosecutor's Office reveals that in the financial statements, there is no detailed analysis of the cost elements for each component service of this project. In fact, in the letter of January 6, 2014, where information was requested from the country's hospitals, they were not informed that this information is required for this project and its component services.

Nuk është bërë inventarizimi dhe vlerësimi i instrumenteve kirurgjikale dhe pajisjeve të sterilizimit, për të nxjerrë më pas nevojat reale për plotësimin e nevojave ose zëvendësimin total të tyre dhe as analizimi teknik dhe financiar për vendosjen në punë të Repartit Qendror të Sterilizimit në QSUT, që ishte i ndërtuar dhe totalisht i investuar me pajisje të reja.

Hetimet nxjerrin se si kostoja e sterilizimit është fryrë në mënyrë fiktive.

“Pa kryerjen e analizës teknike dhe ekonomike financiare të saktë me elementët realë përbërëse të tyre, është bërë arsyetimi i vendimit koncesionit/PPP, duke llogaritur në koston e shërbimeve të QSUT-së (si gjysma e kostos së këtij shërbimi për gjithë Shqipërinë), vlerën 502, 233, 399 lekë, ku në këtë vlerë 283, 287, 369.55 lekë ose 56.4% e saj janë barna dhe materialeve mjekësore që nuk janë pjesë e shërbimit. Të dhënat e pasqyrave financiare nuk janë përshkruar dhe analizuar në studimin e fizibilitetit. Pra në krahasuesin e sektorit publik është fryrë në mënyrë fiktive kostoja e sterilizimit në masën 56.4%)”.

Sipas Memo-s së Zëvendës Ministrit Rjepaj drejtuar Ministrit të Shëndetësisë Ilir Beqaj, ky repart kishte kapacitet për ripërshtatjen e seteve kirurgjikale për 60.000 ndërhyrje kirurgjikale.

Ndryshe nga tabela e pasqyrës financiare të studimit të fizibilitetit, në pasqyrën e MEMO-s është ulur numri i ndërhyrjeve kirurgjikale nga 50 000 në 37 720 dhe duke rritur çmimet për secilën nga intensitetet e ndërhyrjeve.

Sipas prokurorisë, fitimi neto është llogaritur 1, 988 miliardë lekë, ndryshe (664 milionë lekë më shumë) nga pasqyra e Studimit të fizibilitetit që e ka fitim neto 1, 324 miliardë lekë.

“Nga dokumentacioni i dërguar nga Ministria e Financave dhe Ekonomisë, rezulton se Studimi i Fizibilitetit bashkë me pasqyrat financiare të dërguara nga Ministria e Shëndetësisë janë të pafirmosura nga anëtarët e komisionit. Gjithashtu, studimi i fizibilitetit të dërguar mban datën 10.03.2014 ndryshe nga ai i miratuar nga komisioni i dhënies së koncesionit që ka datën 10.10.2014.  Në Studimin e fizibilitetit të dërguar në Ministrinë e Financave, ndryshojnë kategoritë e mbetjeve që do përfshihen në projekt, ku janë vetëm ato të gjeneruara nga furnizimi i shërbimit të Koncesionarit”.

Shkelja e radhës është fakti që Ministria e Shëndetësisë shprehu nevojën për investime në infrastrukturë, në pajisje dhe në tubacione shtesë, por në asnjë moment nuk bëri një përshkrim të detajuar të këtyre nevojave apo ku i kanë marrë të dhënat mbi këto nevoja. Vetë Beqaj, në shkresën Nr. 3082/16 Prot., datë 17 dhjetor 2014 thekson se: “Projekti synon përqendrimin në stacionin qendror të sterilizimit, i cili është një stacion modem i ndërtuar 4 vjet më parë me kredi nga CEB, por që nuk është vendosur ende në shfrytëzim.”.

SPAK evidences that 13,000 interventions were not declared by the Concession Commission, since in 2013, about 63,000 interventions were performed and not 50,000 surgical interventions.

"Considering that all interventions of 13,000, not declared, would be of low intensity, that is, with the bidding price that SaniService won of 13,900 ALL, then it would result that the amount of 1,108,333,450 ALL should be is added and the value of 1,807,000,000 ALL (13,900 ALL/intervention for low intensity * 13,000 interventions * 10 years of duration = 1,807,000,000) would result in a value of 2,915,333,450 Lek. Under these conditions, the Contracting Authority, the Ministry of Health, has chosen as the winner the merger of the EO with the offer that is higher than the total value of the concession, in the amount of 2,915,333,450 ALL (for 63,000 thousand interventions)".

Meanwhile, according to the legal definition for the total value of the Concession, the prosecution explains, it should have been 9,657. 000,000 ALL.

For the former Minister of Health Ilir Beqaj, the Court left in force the decision "obligation to appear" and "prohibition of exiting the country", with the argument of "the need to continuously guarantee the presence of the accused in the criminal proceedings under his charge, as for to ensure the normality of the investigation and trial in the case under his charge, the need to avoid the risk of committing other criminal offenses by him, as well as to ensure that he does not leave, hide but is subject to execution ( serving) of the penalty when the penalty decision has taken final form ".

The court considers that the insurance needs have not been mitigated according to article 248 point 2 and 260 of the Penal Code .
