The decision given five years ago by the Court of Tirana against citizen Gerti Shehu, the 31-year-old who on Tuesday became the protagonist of the event on the "Dëşmorët e Kombit" boulevard, where he punched the chairman of the Democratic Party, is clarified.
In the decision provided by MCN, it is said that the incident took place on August 7, 2017, against which the citizen PV filed a complaint, at the Police Station number 1. He stated that the citizen Gerti Shehu, hit him with fists and objects strong. On the day of the incident, the injured party, a citizen of PV, was working as a security guard at a gym in Tirana. Gerti Shehu went to his workplace, took the TV remote and started moving it.
Regarding this action, the complainant asked him to leave his work environment, but on the contrary, Gerti not only did not leave, but also had a conflict with him. During the debate, the defendant punched the complainant and then hit him on the head with a decorative brick that he took outside his workplace.
As part of the investigative actions related to this event, it was also decided to carry out a forensic examination regarding the injuries suffered by the complainant PV. According to the act of forensic examination with no. ., dated 07.08.2017, it resulted that; In citizen PV, four head wounds with the characteristics and locations mentioned above were found.
The above damages were caused with a hard tool. The injuries caused to PV citizens are included in the category of those that have caused loss of ability to work for more than 9 days. In these circumstances, it has been proven that the defendant Gerti Shehu has consumed the elements of the criminal offense of "Intentional light injury", provided for by Article 89 of the Criminal Code.
At that time, from the investigations carried out by the prosecution body, it was found that the violent actions of the citizen Gerti Shehu were carried out with direct intent and for weak motives (personal conflicts). In the decision, it was not emphasized whether the young man suffered from mental health problems.
"Following this reasoning, after examining the evidence, the Court concluded that the defendant G. Sh. is charged with criminal responsibility and must be declared guilty of the criminal offense of 'Intentional light injury' to the citizen PV, provided for by Article 89 of the Criminal Code. As mentioned above, in the analysis of the elements of the criminal offense, the court concludes that the defendant G. Sh. has committed the criminal offense of 'Intentional slight injury' and for this reason he must be declared guilty based on Article 89 of the Penal Code. .
However, in a detailed assessment of the content, findings and all the circumstances of the criminal offense committed by the defendant, the Court concluded that the type of fine for the defendant G. Sh., requested by the prosecution body is acceptable by the court, as it is in a fair relationship with the evaluation of the circumstances of the commission of the criminal offense", the court decision states.
At the end of the examination of the case, the Court sentenced Gerti Shehu to a fine of 200,000 lek, which he had to repay within a period of one year.
