The Prosecutor's Office at the Court of First Instance in Durrës has confiscated dozens of assets and demanded six years in prison for an Italian citizen, considered a mafia member of the "Camorra" criminal organization.

It is about the citizen Ferdinando Muollo from Naples, who is accused of laundering money derived from criminal activity.

Five apartments, seven garages in the city of Durrës and one car have been seized.

The Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Durrës has heard about the trial within the framework of criminal proceedings no. 831/2018 in charge of the defendant: FM, with Italian citizenship, accused of committing the criminal offense "Cleaning of Products of the Criminal Offense or Criminal Activity" provided by article 287/1 letter "d" of the Criminal Code.

During the trial, it was fully proven that the defendant FM committed the criminal offense for which he is accused.

Regarding the fact of the criminal proceedings against him, the prosecuting body has administered by the Italian Justice Authorities data from which it results, among other things, that the Italian citizen FM, with the Decision of the Court of Appeal of Serious Crimes, Salerno, Italy, pleaded guilty to the criminal offenses provided by articles 110, 575, 577 n.4 cp and 7 DL 13.05.1991 n.152 converted with amendments to the Law on 12.07.1991 n.203 and finally sentenced to 12 years and 6 months of imprisonment , criminal offenses which refer to the murder of a SR citizen, considering the changes in the provisions of articles 575 and 577 carried out by Decree Law no. 152/1991 and no. 203/1991 of the competent authorities in the Italian state.

In the following, from the administered acts of the Letter of Order, it appears that the defendant F. M, in addition to the above-mentioned sentence, has several other cases prosecuted and convicted by the Italian Justice Authorities for lighter crimes and of a mainly financial nature. This citizen was convicted in 1984, 1991 (twice), 1998, 2009, 2011, 2012, 2013 and 2014.

Considering the above facts, as well as for a more complete and objective investigation, it has been decided to conduct an economic examination.

The defendant FM has started to buy real estate in the Republic of Albania over the years. The total amount of investments of the defendant FM, in the Albanian state, according to the Economic Expertise Act conducted during the trial, turns out to be 217,709 euros.

I pandehuri F.M., paratë e përfituara nga veprimtaria kriminale i ka investuar në shtetin shqiptar duke blerë pasuri të paluajtshme. Për blerjen e këtyre pasurive ai nuk ka përdorur transaksionet bankare por ka përdorur lëvrimin Cash të tyre dhe qëllimi i tij ka qenë fshehja e origjinës së pasurisë (parave) të fituar në mënyrë të paligjshme, që më vonë pasuria e re e krijuar të duket e ligjshme.

Nisur nga sa më lart rezulton se i pandehuri F. M ka konsumuar elementët e veprës penale “Pastrimi i produkteve të veprës penale ose veprimtarisë kriminale” të parashikuar nga neni 287 germa ”d”  i K.Penal, d) investimit në veprimtari ekonomike ose financiare të parave a sendeve, duke ditur se janë produkte të veprës penale ose veprimtarisë kriminale.

Sa më sipër, bazuar në nenin 378/1 të K. Pr. Penale, Prokuroria Pranë Gjykatës së Shkallës së Parë të Jurdiksionit të Përgjithshëm ka kërkuar:

Deklarimin fajtor të pandehurit F.M për veprën penale të “Pastrimi i produkteve të veprës penale ose veprimtarisë kriminale” të parashikuara nga neni 287/1 germa ”d” të K.Penal dhe dënimin e tij me 6 vjet burgim.

Në aplikim të nenit 36 të K. Penale konfiskimin e pasurive si më poshtë:

Pasuria, Sip.86,538 m2 apartament në Durrës (sip. Në bashkëpronësi është 11,495 m2 + 72.7141 m2 tarracë),;

Pasuria, Sip.69,9 m2 apartament në Durrës (sip. Në bashkëpronësi është 7,684 m2);

Pasuria, 8518, Sip.80,05 m2 apartament në Durrës;

Pasuria, Sip.91,294 m2 apartament në Durrës;

Pasuria, Sip.13,525 m2 garazh në Durrës;
