Hearing on the "Balluku" case/ SPAK Prosecutor: The Prime Minister

SPAK prosecutor Dritan Prençi has given his arguments, explaining why in the case of Belinda Balluku's suspension there is no conflict of competence, as Prime Minister Rama claims.

In his speech before the Constitutional Court, Prenç said that the applicant, who in this case is Rama , 'cannot use this claim to block the criminal investigation against the minister, since criminal prosecution and the assessment of the suspension measure are the competences of SPAK and GJKKO and cannot be violated by the intervention of the executive branch .'

According to him, the prohibitory measure only affects the individual and not the council of ministers.

" There can be no claim of a conflict of powers. In order for there to be a conflict of powers between powers, three legal criteria must be met. The dispute arises between bodies of different powers, the dispute is related to the bodies that decide the will of their power, and the dispute is related to the determination of the sphere of powers. In the specific case, these conditions are not met.

SPAK assesses that the Prime Minister's request for the repeal of the GJKKO decisions on the personal security measure or for the interpretation of Article 103, point 3, is not related to the constitutional control over laws, and does not represent a conflict of powers between the powers.

"We believe that the applicant cannot use this claim to block the criminal investigation against the minister, as criminal prosecution and the assessment of the suspension measure are the competences of SPAK and GJKKO and cannot be violated by the intervention of the executive branch ," said prosecutor Dritan Prençi.
