In 2024, the High Inspector of Justice requested disciplinary proceedings, respectively at the Supreme Court of Justice and the Supreme Court of Justice for 11 magistrates, 6 judges and 5 prosecutors, requesting dismissal for all six judges and other measures for the representatives of the prosecution.

The report submitted by the ILD itself to the Albanian Parliament states that out of 6 requests for dismissal of the black platoons, the High Judicial Council has accepted the dismissal of 2 judges, one has been dismissed, one is suspended and 2 others are still in the process.

Regarding requests for disciplinary proceedings against prosecutors, milder requests are noted, for reprimands in 2 cases and temporary salary reductions in 3 cases. Of these, the KLP has accepted one salary reduction, dismissed 2 and has 2 others in process.

Violations observed by the ILD during investigations of judges and prosecutors are repeated delays or those that lead to serious consequences or unjustified procrastination; serious or repeated disregard for legislation; violation of the rules of incompatibility or prevention of conflict of interest; use of the status of a magistrate, with the aim of creating benefits for oneself or for others; action, inaction or behavior of the magistrate, which brings unfair benefits or damages to the parties in a judicial process or investigative procedure; repeated or serious violation of the rules of solemnity and behavior in relations with the parties, as well as cases where the judge has been convicted by a final decision for committing a crime.

The ILD report states that in 2024, an increased number of complaints was noted, compared to the previous year, with 1491 new complaints, of which 1376 complaints were filed by citizens and 115 by institutions. 1363 complaints were carried over from 2023, making the total 2854 complaints to be handled.

During the 365 days of 2024, the office of the High Inspector of Justice has reviewed 1374 complaints, of which 993 were archived after the initial review, 327 others were archived, and only 54 complaints ended in disciplinary investigation.

But who do Albanians complain to? According to the ILD report, out of 1,374 complaints reviewed, 642 of them, or 47%, were against judges, 357, or 26%, against prosecutors, 284 complaints against judges and prosecutors together (21%), while 7% of the complaints, or 91, do not identify the subject against whom the allegations are made.

The largest number of judges accused by complainants are in the General Jurisdiction Appeals Court with 208 complaints or 15% of the total, followed by the Tirana Court of First Instance, the one in Fier, and so on.

The situation is different with the prosecution body, where complaints against prosecutors in the General Appeal are only 2% or 34, while the most 'accused' prosecutors are those of Tirana with 201 or 14%, followed by Durrës and Elbasan.

When we talk about the judges of the GJKKO and the prosecutors of the SPAK, the situation is different. Of the total number of complaints reviewed, 1374, only 12 were for special judges of the first instance or 1%, and a little more for special prosecutors, 25 such or 2% of the total. Only one complaint was handled for the GJKKO of Appeal.

Regarding reports from court heads, for 2024 there was only one head who forwarded a total of 2 complaints to the Office of the High Inspector of Justice. While from the heads of prosecution offices, 3 heads submitted 20 complaints, one 12, another 7 and the third 1.

2 were cases transferred from the Independent Qualification Commission, while the High Court followed up on a total of 4 decisions during 2024, where it judged requests for ascertainment of violation of the trial deadline. Meanwhile, the Prosecutor General and the Minister of Justice did not file any appeals for the entire year.
