The Independent Qualification Commission announced on November 7 the decision to suspend the vetting of the prosecutor of Elbasan, Bledar Mustafaraj, after his resignation from office. Also, Mustafaraj was prohibited from appointing him for 15 years in some functions in the justice system.
In the reasoned decision of the KPK, it is clarified that Mustafaraj was drawn in December 2020 and in September 2023 the administrative investigation was closed in the three criteria of reevaluation, that of wealth, purity of image and professionalism. He asked for a postponement to return an answer, which was accepted by the Commission and subsequently submitted his evidence and explanations to the burden of proof.
At the same time, he informed the KPK team that on October 5 he had filed with the High Council of the Prosecution, KLP, the request for ending the status of the magistrate. The commission has learned that on October 20, the KLP decided to declare the termination of the status of the magistrate for the prosecutor Bledar Mustafaraj due to his resignation.
The subject has informed the KPK team that he has not appealed against this decision of the KLP and that he does not want to participate in the hearing.
Based on these circumstances and on Article G of the Annex to the Constitution, the Commission has decided to declare the termination of the transitional re-evaluation process for prosecutor Bledar Mustafaraj and to prohibit him from being appointed as a judge or prosecutor of any level, member of the Supreme Judicial Council or the Council of High Prosecutor, High Inspector of Justice or General Prosecutor, for a period of 15 years.
