"I am being BLACKMAILED by 5 candidates for magistrate", Director of
Arben Rakipi

The Director of the School of Magistrates, Arben Rakipi, stated that he is being blackmailed due to his position as head of the School.

Rakipi refused to name names, but hinted that the blackmail comes from within the system.

He provided some details about the case for which he said he is under blackmail. And, according to his analysis, he is not the only one.

This concerns the case of the expulsion from school last year of 5 candidates for magistrate, after they were caught cheating.

Rakipi also spoke about the impact he has on the justice system and answers a question that is often asked in political, media, and justice circles.

Question:  9 years after the adoption of the justice reform, in which you had a key role as a senior expert, has the reform fulfilled its main goal, to ensure persons with integrity in the justice system?

Arben Rakipi:  This is a question that strikes at the heart, not me, but the system. The integrity element in its entirety leaves much to be desired. I see ease in violating the rule, ease in violating the law, I see a lack of humanity, a lack of interest in fighting for the public good, I see avoidance of addressing essential matters. I am talking about the entire system, starting with our school. In our school, 5 students were expelled because they cheated during the exam. This was an unusual event in our school and their expulsion came as a result of violating the Code of Ethics and Integrity that we believe a magistrate should have. The serious violation reflected exactly that weakness that I just mentioned - the ease with which the law is treated, giving no hope that the future judge will have this kind of dignity.

Question:  Those you have expelled hold you responsible for treating other people who have also cheated differently. They have informed many domestic and foreign institutions about this.

Arben Rakipi: What is being said is just blackmailing the courts that are reviewing the case, blackmailing the school to ease its stance towards those who were penalized, and blackmailing the school in anticipation of this year's entrance exam.

Question: Blackmail from those five? Are they so powerful that they are not yet prosecutors and judges?

Arben Rakipi: Ka shumë interesa këtu, ka njerëz që i mbështesin. Plagjiatura në këtë sistem, përvetësimi i titujve akademikë dhe kapardisja me to kur nuk i meriton është një ves dhe sjellje shumë e përhapur në sistem. Këtu e shoh dhe arsyen që integriteti i sistemit duhet marrë seriozisht.

Pyetja: Thuhet se keni një influencë të madhe në SPAK, për shkak të njohjes personale me drejtuesin e SPAK-ut, Altin Dumani. Është e vërtetë?

Arben Rakipi: Edhe ky është një banalitet që vjen nga shumë arsye, që lidhen me alibira që njerëzit duan t’i krijojnë pozicionit të tyre dhe për t’u vetë pozicionuar si viktima. Unë kam qenë një prej ideatorëve të krijimit të këtij institucioni, sepse përgjatë punës sime, dikur, formova eksperiencën që grupet e përzgjedhura të prokurorëve janë më të vullnetshëm apo më të aftë për të luftuar në nivel kombëtar një lloj krimi. Këtë praktika e ngjiza, hodha një farë të mirë në krijimin e kësaj strukture, që, më vjen mirë ta them, po lulëzon. Në këtë pikëpamje, e thënë trashë-trashë, mund të jetë ndikim, por është ndikim i mirë. Tani, a ndikoj unë në sistem? Unë ndikoj në sistem, sepse jam model për t’u ndjekur, më falni se do të heq dorezat e modestisë. Nëse nuk i them këto gjëra, nuk do të jem i kuptueshëm. Jam model për t’u ndjekur për shkak të modelit të lartë që përmban personaliteti im, ndershmërisë në marrjen e vendimeve, aftësive të larta profesionale që kam, dhembshurisë së madhe për viktimat, humanizmin që më shoqëron gjatë gjithë kohës, patriotizmin e madh që më karakterizon, me dashurinë pa fund për këtë vend dhe për sistemin e drejtësisë. Për rrjedhojë, do të ishte e zgjuar, e mençur, dobiprurëse, përfituese për cilindo që më ndjek. Kam edhe një arsye tjetër që të kem ndikim në sistem për shkak të kësaj detyre që bëj. Ne zhvillojmë trajnime pafund në këtë shkollë, 1/3 e së cilës i përmbahet etikës dhe integritetit. Është një nga objektivat e trajnimit që të ketë ndikim në pjesëmarrësit e tij, përndryshe, trajnimi është i kotë. Nëse unë kam ndikim, përveç asaj që thashë, do të ishte realizim i nivelit më të lartë të pranuar nga standardet e BE për efektin që duhet të ketë trajnimi në sistem. Sidomos për këto elementë që përmenda, ata që janë të mençur, ata që janë shpresë e këtij vendi, ata që duan t’i shërbejnë vendit dhe njerëzve kanë zgjedhur të më ndjekin mua. Me këtë nuk dua ta vë veten në nivelin e profetit apo të predikuesit, por në nivelin e një personaliteti me integritet, dua të vete paraqitem tani pa doreza si i tillë, në mënyrë që të gjithë të këqijtë, dashakeqësit, të mos lodhen kot për të më ndryshuar, apo për të më shantazhuar, apo për të më larguar nga ky piedestal, në të cilin më ka vënë puna, energjia, sakrifica që kam bërë dhe kolegët që më njohin.

Pyetja: Po ju shantazhojnë aktualisht?

Arben Rakipi:  The smear campaign, which has a long history and is precisely related to the fight between evil and good, continues. And I don't call it anything else, except blackmail to get out of work. So, I wanted to say that the influence comes for these reasons, not because I am the director of the School of Magistrates, not because I am the former Attorney General of this country, not because I am a lawyer. It comes because of that pedestal that I mentioned. I apologize once again for the gloves I took off, but otherwise I would really be misunderstood. Maybe the time has come to say a few things.

Question: You must be in a delicate position to be saying these things, but perhaps time will clarify this issue. To close the quiet interview, will you give me a direct answer to the question, if you are friends with Altin Dumani and influence him in decision-making?

Arben Rakipi :  I know 99.99% of the boys and girls who work in the system, of whom about 50% I have appointed, I am talking about the prosecution, when I exercised the function of Prosecutor General (1997-2002). Consequently, identifying Altin Dumani as my friend, it seems to me, is intentional to deform and to lead into a malicious channel the insinuation that this acquaintance is special, because this gentleman currently has a special duty. I am a friend of many people, a friend in the sense beyond what I have appointed, because life has connected me with some more than with some others. In no case, at no moment has this friendship been established for cases or issues that constitute the subject of our work. Neither his, nor mine. I want to assure you that this gentleman has one of the qualities of his personality, he has independence! The independence he possesses and his desire to present it also guarantees the absence of anyone's influence.
