A few days ago, the Independent Qualification Commission made public the data on the progress of the re-evaluation process.
This commission published the data from February 8, 2018 to October 31, 2024, where it was learned that 799 decisions had been given, so 6 more were expected to complete the entire process of the 805 magistrates who passed through the sieve of this commission.
The KPK has already completed the re-evaluation process with the last 6 people of justice who had to pass this stage, while the decisions taken by this commission have not yet been clarified for them.
In fact, it has long been said that the KPK panel of judges would complete the process in December and then requested that they be part of the justice system at the Appellate level and above and not at the first level of trial in the country.
However, regarding their "fate" of their position in the system, there is still no information from the High Judicial Council.
The process went through three important stages in fact, but there were not a few "battles" of the magistrates in front of the findings that the body of the Independent Qualification Commission had fixed, that at the end of this process, it passes the "baton" to the KPA that it will be like the second degree of judgment for all those who are against the decision given by the KPK.
process
In more than 6 and a half years, this body passed through the hands of a multitude of files and practices of the people of the justice system.
Not a few times disputed, even their decisions ended up in Strasbourg and it is learned that there will be other decisions that will go to the International Court to test the right of the judges and prosecutors, who do not agree with the findings of this Commission.
In addition to the professional criteria, wealth and purity of image, which were the pillars of the revaluation, it is learned that a great help in the direction of this revaluation was also provided by the citizens, who were taken as a basis by the members of the Independent Qualification Commission.
According to the data of the KPK, there are thousands of denunciations that have arrived at the Commission's address for almost every subject that has passed through the vetting sieve, all the personal experiences of citizens who have passed through these prosecutors and judges who have agreed to pass through vetting.
But if you look at all the decisions given and announced by the KPK, the property criterion was the most powerful one, which the largest percentage of subjects could not justify.
The Independent Qualification Commission has already spoken about all 805 judges, prosecutors and legal assistants, while, according to them, only 373 of them have been confirmed as having no problems, among which 165 judges, 167 prosecutors, 2 were inspectors in KLD, 2 inspectors in HCJ and 37 legal assistants/advisors.
It is also learned that 268 magistrates have been considered problematic by the KPK, in at least one of the pillars of the re-evaluation, and decisions have been taken to dismiss them.
Of these 146 judges, 1 former judge in the Supreme Court; 116 prosecutors, 1 inspector at the HCJ and 4 legal assistants. 49 decisions are for the end of the process without a final decision, of which 26 former judges, 17 prosecutors; 1 former chief inspector in KLD; 2 former inspectors in KLD and 3 legal assistants. 105 decisions on interruption of the process due to resignation; 61 judges, 27 prosecutors, 1 former prosecutor; 1 former judge, 1 ex-inspector in KLD and 14 legal assistants.
After the end of the process in the KPK, the vetting will continue at the second level in the KPA, whose members have a 9-year mandate, until the end of 2026.
The protection of ONM's recommendations will not be done by the Public Commissioner whose mandate ends, the same as with KPK, but according to the Constitution, SPAK prosecutors.
The public commissioners have requested to be attached to the Special Prosecutor's Office, while the members of the Independent Qualification Commission will receive the status of judges, although their new positions have not yet been determined.
