A legal employee for 4 years in a row has accused the judge with initials BH of insult, but the Court of Tirana has recently given the decision in favor of the judge.

This decision revolted the chronicler journalist Anila Hoxha, who reacted through a post on social networks.

In addition to the spelling mistakes, the judge wrote insulting notes to the judge such as "illiterate, illiterate, buy a primer, .. put a hysterical comma" and the court did not consider these words as offensive and insulting words.

Is the word illiterate an insult or not? What about the word tyryfyle? Well, the Courts in Albania say no. Moreover, the court went into so much detail that in 30 pages the decision was made even with the value of a comma. The famous story of Lenin's arrest, which is said to have saved him during the tsarist regime, has been repeated in our country during a criminal trial in Tirana in which the accused for the arrest was a judge and the accuser a legal assistant. The judge with the initials B. H for four years in a row was accused of insults by the legal assistant J. B, a 44-year-old who insists that she was insulted more than once. For this, the prosecuting lawyer submitted several years' worth of work, several legal opinions, preliminary reports for the decisions that were then announced by the judge. In them, the judge wrote next to the spelling errors notes that in Albanian have an offensive meaning such as "illiterate,

But the judiciary investigates the conflict and assumes the role of Albanian language professors. It teaches us for the first time what is an insult and what is not.

Two courts over the years evaluated the meaning of each expression and stopped at length on the comma.

- Is it a historical comma, or does the comma when it is not written make the text writer hysterical???? This is the judicial dilemma for anyone waiting for the queue and the stock of files that are barely tried!

When the plaintiff requests (in the conditions of a justice that is being emptied by vetting) the punishment of the judge for the accusation of insult because it violated her dignity, the judges estimate that there is no room to accept such a claim.

The evidence submitted by the legal assistant in this rare process:

1.Vendim i cështjes 2015 të shpallur nga gjyqtarja në 2017 në të vilin ajo bën një korrigjim në tekstin e ndihmëses duke shtuar presjen e duke shkruar “ ke dy vjet që nuk e vë këtë presje, bli nje abetare!’
2.Relacion numër akti 87gjyqtarja shton presjen dhe I shkruan “ vër presjen histerike”
3.Relacion 1899 , shton me shkrim dore: cështë kjo shkarravinë!
4.Projekt vendim 5436 , gjyqtarja korrigjon mbiemrin Lleshi në Lleshaj dhe shton “ Lleshaj o analfabete”
5.Relacion 9857 gjyqtarja shton në prohekt vendim “ tyryfyle , shkruaj saktë të paktën numrat”
6.Relacion 9340 gjyqtarja shton në punën e ndihmëses “ vazhdo fli mbi dosje, lajmëro kur të zgjohesh”

Për këtë luftë “ presjesh” më herët ishin vënë në dijeni një sërë insitucionesh që nga ministria e organet e gjyqësorit dhe në fund investohet edhe gjykata. Ndihmësja ligjore saktëson se në shënimet e gjyqtares kuptimi shqip I frazava që iu shkruan me shkrim dore janë fyerje , denigrim dhe cënim dinjiteti.

Në këtë gjykim, gjyqtarja e akuzuar shpjegon se shkroi ‘ analfabete” për vartësen në mënyrë që ajo të merrte masa për të lëvrimin e gjuhës shqipe dhe se nuk synoi ta fyente, por dha një opinion për të treguar realitetin.

Për konsideratën “ tyryfyle” gjyqtarja shton se pavarësisht kuptimit që cilëson një person të shpërndarë , kjo fjalë nuk gjendet në fjalorin shqip; kështu që nuk është fyerje.

Dhe sa për presjen HISTERIKE APO HISTORIKE gjyqtarja e akuzuar detajon se nëse do kishte dashur ta fyente do shkruante : – moj histerike vër presjen! Por ajo kishte dashur të shkruante VER PRESJEN HISTORIKE ngaqë kishte dy vjet që vartësja nuk e vinte.

‘ Mos vënia e presjes në dy vjet e konvertoi atë në historike “ shpjegon e paditura. Gjyqtarja këmbengul se keqkuptimi buron nga kaligrafia  e shkrimit të saj.

Për ti bindur kolegët se historia e presjes duhej mbyllur në favor të saj , gjyqtarja shton edhe vendimin e vettingut që e konfirmoi atë në detyrë

Gjykata kryen një hetim të imtësishëm, merr informacione për ndihmësen ligjore, aftësitë e saj, përkushtimin, 32 opinione të përgatitura prej saj , projekt relacione dhe dhjetra projekt vendime dhe në fund nuk konsideron se fjala analfabete , tyryfyle janë fyerje. ‘ Këto fjalë nuk janë bërë me qëllim për të fyer dinjitetin e akuzueses , por për të treguar qartazi mospajtimin me punën e ndihmëses ligjore” deklaron gjykata e shkallës së dytë në shpalljen të pafajshme të koleges.

Kurse për presjen që I solli pafajësinë gjyqtares B.H gjykata deklaron : Nisur nga sintaksa e fjalisë duket që përmbajtja e shënimit të bërë nga e akuzuara është “ vër presjen historike” dhe jo “ vër presjen histerike” . Për rrjedhojë vërejtja nuk ka asnjë fjalë apo shprehje që mund të interpretohet si ofenduese.
