Jani Rustemi, 28, was arrested on April 13, 2023 after being wanted for the theft of a carpet and a pair of sneakers.
After 24 hours of isolation in the detention cells at 'Mine Peza' in Tirana, he felt unwell. Despite his health problems, the young man appeared before the court the next day and was given the security measure 'arrest with prison'. Due to overcrowding, he was not transferred to prison 313, but was returned to the Tirana Security Block.
According to the police report, on April 17, he again showed health problems and was urgently admitted to the QSUT. The young man fell into a coma and died almost a month later, on May 20. Despite the fact that his lawyers and family have launched a legal battle, two years later it is still unclear what happened to the young man.
The Helsinki Committee that monitored the case stated at the time that the 28-year-old, known as a drug user, was treated with methadone a day after being admitted to the Security Block, but the young man's medical record does not show that any medical analysis was performed on his condition and the continuation of the treatment, even though he showed complications. After his condition worsened, he was treated with diazepam, but without specifying the dose and why this treatment was recommended.
The incident still raises many questions, adding to the uncertainty for the family. They suspect that their relative was neglected by all authorities, leading to his death. He was isolated in prison while he needed treatment. A few days after his son's condition worsened, his mother filed a complaint for lack of proper treatment. But justice has not yet been served for him.
For the family, the only thing that would bring them peace is the truth. Why was the young man isolated in a cell just because he stole a pair of sneakers and a carpet, while he needed urgent treatment? The case seems suspicious since the criminal code itself stipulates that drug addicts cannot be sentenced to prison, only if they have committed very serious crimes.
"If someone has passed away, it is a big alarm for the institution, civil society, it is very important to regulate the law," said Elsa Ballauri, activist.
