The Tirana Prosecution Office completes the investigations and submits for trial the criminal file against the former IMT chief inspector, Ardian Halili, who is charged with "Illegal construction" and "Abuse of office". Meanwhile, Saimir Mezja, a lawyer by profession and currently an inspector at IMT Durrës, is accused of abuse of office.

The investigations revealed that the former IMT chief inspector, Halili, had built the luxury complex "Saint Michelle Residence" without permission, which was later demolished by IKMT.

From the inspection of the scene, it was evident that in the subject "Saint Michelle Residence", located in the village of Shetaj, Ishëm Administrative Unit, Durrës Municipality, on the right of the road, on the northern side, there is a two-story building, where the upper part serves as a functional bar-restaurant, while in the lower part there are several accommodation rooms that serve as a hotel.

To the right of the concrete-paved road are 11 one-story buildings, with concrete floors on their foundations. The first five buildings are functional, while the others are not functional as they have no doors or windows. The last building, which coincides with the northwest side and is near the swimming pool, serves as a bar-restaurant.

During the inspection, it is observed that on the left, at the entrance to the building, next to the concrete road, there are ten other buildings with concrete floors at their lower parts. These buildings are covered with tiles. Five of these buildings are functional and contain furniture that serves to accommodate people. The other five buildings are non-functional, without doors and windows, and only paved at the bottom with a layer of poor concrete.

In the first building on the left and on the first floor below the bar-restaurant, which serves as a hotel, the interior furnishings were being removed. Also, in buildings no. 9 and 10, the tiles had been removed and piled up at the beginning of the building's facade.

Halil's testimony

"...It is not at all true that construction work was being carried out at the "Saint Michelle Residence" entity, but since I was informed by the IKMT inspectors that the building would be demolished, we tried to remove some items, various furnishings.

All the work that has been carried out is according to the permits obtained from the Municipality of Durres some time ago and today I was not carrying out any kind of work. We support what I am saying with the footage recorded in our facility.

Regarding the works carried out for the pergolas, a procedure was held by IMT Durrës, for which the Prosecutor's Office decided not to start since there is no illegal construction and at the end of the administrative process the court ruled in our favor, deciding to repeal the decisions taken by IMT Durrës. The works were carried out some time ago and are in accordance with the permits approved by the Municipality of Durrës, for which I have the relevant documentation and make it available.

Asked if he had a building permit for the 11 (eleven) buildings in the "Saint Michelle Residence", if not, when they were built, the person under investigation responded, among other things, that the 11 buildings do not constitute unauthorized construction since they are made of polystyrene material and have a wooden roof.

Despite Halili's claims, the Prosecution has managed to establish that the complex was built over several time phases.

Ardian Halili, according to letter no. 2818 Prot., dated 11.11.2025, of the Inspectorate of Territory Protection, Municipality of Durrës, was assigned to the position of Chief Inspector on 26.04.2018 and was notified of the termination of his employment on 19.03.2021.

He had appointed inspectors to ascertain illegal construction in the area where he owned the complex.

The testimony of the co-defendant

Saimir Mezja stated that: "...I started working at IMT Durrës on 17.06.2019 and I continue currently. According to the relevant orders, I was also assigned to control the territory in the Ishëm Administrative Unit from 17.06.2019 and I continue currently.

I explain that I was aware that this land area was owned by citizen Ardian Halili. When I started work, on 17.06.2019, as I recall, a bar-restaurant and parking lot were operating on this property. I clarify that, despite the division of inspectors according to work orders, in this territory the chief inspector also ordered other inspectors to carry out inspections.

According to functional duties, for construction works carried out in implementation of a construction permit or a decision to approve a declaration of completion of works, the inspection is carried out only by order of the chief inspector and not on the initiative of the inspector. In the specific case, for the works carried out on the property of citizen Ardian Halili, I heard that he was provided with the relevant permits from the Municipality of Durrës, but I could not enter the property to inspect the works without a written order from the chief inspector. I have not had any influence from citizen Ardian Halili, my former superior, for inaction regarding the works carried out on his property.

I also clarify that, during the entire period that I have been assigned to control this territory, I have not received any written or oral order to inspect the works on the property of citizen Ardian Halili, in order for me to carry out actions according to my functional duty."

Inspector's testimony

G. Hidri stated that: "...I started working at IMT Durrës on 29.12.2017 and I continue currently. According to the order of the chief inspector no. 06, dated 21.01.2021, I was also assigned to control the territory in the Ishëm Administrative Unit from 21.01.2021 to 17.05.2021.

My functional duties as an inspector are to control the territory and, if construction works are detected, we verify whether these works are being carried out with the relevant permit.

In cases where construction works are carried out in entities that have the relevant permit posted, the inspection is carried out only by written order of the chief inspector. I explain that I was aware that this land area was owned by citizen Ardian Halili. During the inspection of this territory, I noticed that parking activities for “Roller” vehicles were taking place on this property, as there was also a sign at the entrance for this service. When I passed by this entity, I did not notice any construction works and I did not notice any permit posted for carrying out works.

In 2022, based on a notification from the State Police, where they informed us of some construction works that were being carried out at Cape Rodoni by citizen Ardian Halili, after we went to the site together with police officers, during the investigation we noticed that the permit obtained from the Municipality of Durrës was not according to the works carried out by this citizen.

Specifically, the permit granted was for the installation of pergola awnings, while the violations of the permit were the enclosing of these structures with gypsum material and its change from an awning to a structure enclosed with gypsum.

"These works were not in accordance with the permit issued by the Municipality of Durrës and we have carried out the legal procedure, the act of determination and the report. Subsequently, the relevant decisions have been taken by the chief inspector."

Police officer's testimony

Xh. Hoxha stated that: “...I have been appointed as a Community Policing Specialist in the Ishëm Administrative Unit, which also includes the village of Shetaj (Kepi i Rodonit), from November 2019 to December 2021. I explain that in the “Saint Michelle Residence” complex, owned by citizen Ardian Halili, during the period that I covered this territory, I have not observed any construction works, and I have never entered the interior of this complex. As far as I remember, this complex has been completed. Also, I have not received any notification or complaint, either from IMT inspectors or from various citizens. I do not know citizen Ardian Halili personally.” /VNA
