A person has been sentenced to 5 years in prison for committing obscene acts against his minor niece. At the request of the Fier Prosecutor's Office, the person with the initials SH was sentenced.

Full announcement: 

Citizen SH was sentenced to 7 and a half years in prison at the request of the Fier Prosecutor's Office for committing shameful acts against his minor niece.

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier completed the investigations and sent citizen SH to trial for the criminal offense of 'Indecent Acts' provided for by Article 108/2 of the Criminal Code.

Within the framework of the investigations into criminal proceedings no. 811 registered after the report at the Lushnja Police Station on 04.06.2024, the Prosecution proved that the defendant SH committed unlawful and direct acts against his minor niece EH, aged 11, (repeated at different times).

Defendant SH repeatedly threatened the minor that if she told anyone he would kill her, so the prosecuting authority was made aware of the criminal act by the Child Protection Unit and the psychology department of the minor's school after drastic changes in her behavior were noticed.

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier concluded that the actions committed by the defendant SH against his minor niece EH have violated the minor's psychological and emotional integrity, causing her psychosocial consequences, such as: fear of living alone in the apartment where she lives with her parents, uncertainty about the future, etc., and their source comes from the harassment and shameful acts that citizen SH has committed against her.

Based on the request of the prosecution, the First Instance Court of General Jurisdiction in Fier decided: The guilty declaration of the defendant SH for committing the criminal offense "Indecent Acts" provided for by Article 108/2 of the Criminal Code and his sentence to 7 (seven) years and 6 (six) months of imprisonment. In application of Article 406 of the Criminal Code, 1/3 (one third) of the sentence is reduced and finally the defendant SH is sentenced to 5 (five) years of imprisonment.
