The Special Court of Appeal for Corruption and Organized Crime announced today the decision for the former director of Tirana Parking, Eglantina Zere , and 4 other officials, specifically Enkeljda Qyta, Bruno Koçi, Rivjola Baxha, and Kristo Zhulati, mitigating their sentences. 

Eglantina Zere has been sentenced to twelve months of probation, with the defendant being required to maintain contact with the Tirana Territorial Branch of the Probation Service, under whose jurisdiction she resides, on condition that she does not commit another criminal offense during the probation period.

According to the Appeals Court decision, the defendants were found guilty of committing the criminal offense of “ Violation of equality of participants in tenders or public auctions ” and each was given a sentence of 9 months in prison, which was reduced by one third in accordance with the Code of Criminal Procedure, resulting in 6 months in prison for each.

The defendants were also disqualified from holding public office for a period of 5 years.

But today the Court of Appeal decided to suspend the execution of the conditional prison sentence for all defendants, placing them under probation for a period of 12 months.

SPAK's accusations:

Tirana municipality officials are accused of illegally favoring a company owned "de facto" by the former head of the Water Supply Company, Redi Molla, and the head of IMT, Mariglen Qato, by feeding it public tenders.

The former general director of the Tirana Parking institution, Eglantina Zere, and four other Tirana Municipality officials, Rivjola Baxha, Enkelejda Qyta, Bruno Koçi and Kristo Zhulati, were held criminally liable for the charge of "Violation of equality of participants in public tenders or auctions."

SPAK investigations:

According to SPAK, during the preliminary investigations, it was proven that the defendant Eglantina Zere, in the capacity of the head of the contracting authority "Tirana Parking", an institution subordinate to the Municipality of Tirana, in collaboration with the defendants Enkelejda Qyta, Bruno Koçi and Rivjola Baxha, in the capacity of members of the Bid Evaluation Commission and the member of the Procurement Unit, Kristo Zhulati, have created unfair advantages and privileges for the merger of the winning economic operators "VAS Konstruksion sh.pk" and "Rroku Guest" sh.pk, in the procurement procedure with the object "Reconstruction of the Selman Stermasi parking lot", held on October 1, 2019.

The prosecution noted in court that the evidence collected during the investigations fully proves the fact that the verification and evaluation of the offers of the economic operators that participated in this procurement procedure were not carried out by the members of the KVO, but by other persons who worked at the company "5D Konstruksion" sh.pk.
