The former Public Commissioner, the late Darjel Sina, was against the vetting of Special Judge Irena Gjoka. Sina was later appointed as a member of the Supreme Court, to be succeeded in office by Commissioner Irena Nino. The latter, with a sudden decision orchestrated by the clans in the judiciary, withdrew the appeal, causing the decision of confirmation to remain in force.
VoxNews has exclusively obtained the decision of the former Public Commissioner, dated June 12, 2020, number 204\5, which appeals against decision number 241, dated February 26, 2020, of the Independent Qualification Commission, for the re-evaluation subject Irena Gjoka. However, this decision has surprisingly disappeared, to be followed by another decision, which required Gjoka to remain in office.
A very big paradox, even among the institutions of the "new justice", which are daily immersed in inevitable scandals, with appointments and falsification of documents. Created to cleanse the ranks of judges, prosecutors and legal assistants, the members of these institutions have acted in many cases in a very suspicious manner, as is the case here, where one decision is followed by another, with a different content.
If Sina demanded the dismissal of Judge Irena Gjoka, Nino decided to reconfirm her. The decision of the former Public Commissioner, who was appointed as a judge in the Supreme Court in 2022, provides evidence that the KPK's decision to confirm her in office was wrong.
The former Commissioner writes that "proven circumstances and facts have resulted, that the subject, for the asset criterion, has not provided concrete evidence and convincing explanations regarding the source of the creation of the assets of the subject and the persons associated with it, and has made incorrect and insufficient declarations over the years, and results in a lack of legal financial resources."
According to him, the judge stated incorrect data for an apartment, as in one case she wrote that she had taken a 2 million lek loan and a year later she stated that this obligation was owed to her brother. Inaccuracies were even found in later statements, as Judge Gjoka would write that she had 1.7 million lek.
"It was a wrong interpretation of the law on my part in 2004," she declared, without being subsequently verified by the KPK. "The Public Commissioner assesses that the subject of the reassessment did not declare the savings possessed in cash in DV-2004, and consequently the source of the amount of 1,700,000 lek is not justified by legal income," the document states. In another case, the judge declared that she saved so much from her salary because at that time, in 2005, she was living with her parents and did not incur vital expenses.
The judge stated that she also received money from an olive grove in the city of Patos, but the Commissioner stated that there is no evidence that she benefited and made money from this property.
The former commissioner has also proven another lie to judge Irena Gjoka. "The subject has not been accurate in declaring the cash balance over the years, as she has not declared the amount of 1,000,000 lekë," the decision states. There are even gross errors regarding the purchase of a vehicle. The commissioner also proved another transaction of 34,500 USD, where the judge's husband would enter the gambling business.
"My husband would cooperate with Mr. * and Mr. *.* in the field of gambling activity, a field in which he also operated with a company and had previous experience. This amount of 34,500 USD was provided by a friend of my husband, then returned to its owner, within that same year," Gjoka would declare.
In the end, the former Public Commissioner shared a contrary judgment with the KPK, as he assessed that the subject of the re-evaluation does not reach a credible level for his confirmation in office. “The Public Commissioner requests that the causes of this appeal be considered by the Special Appeals Panel and, at the conclusion of the review of the case in a public session, to decide to amend decision no. 241, dated 26.2.2020, of the Independent Qualification Commission, and to dismiss the subject of the re-evaluation, Ms. Irena Gjoka,” wrote former Public Commissioner Darjel Sina.
A few days ago, the General Prosecutor's Office found that Judge Irena Gjoka had cheated in the decriminalization process. She had concealed and lied to the justice authorities, as she wrote on the form that she had not been investigated, convicted or deported from another country.
According to a document (above), which is a representation of the prosecutor, the judge herself admitted years ago that she authorized a Greek lawyer to remove the punitive measure. Meanwhile, later in a letter sent to the Supreme Court of Justice, she accepted the sentence and the ban on entering Greece.
