The Constitutional Court has decided to reject the request of the Assembly to send the mandate of former minister Olta Xhaçka to the Venice Commission .
The president of the Constitutional Court, Holta Zaçaj, is expected to declare before the media at noon today the reasons for the rejection of this request .
We recall that on Monday, July 8, the Assembly addressed a request to the Constitutional Court, requesting the reopening of the judicial review regarding Xhaçka's mandate, in order to seek an advisory opinion from the European Commission for Democracy through the Law.
Help was requested with the argument that lawyers in Albania are facing legal uncertainty regarding this case.
"Situated in the conditions where a legal uncertainty is created, as to why the group of no less than 1/5 of the deputies cannot set the Constitutional Court in motion contrary to the constitutional order in force, the Assembly is of the opinion that an opinion should be requested advisory by the Venice Commission", says the request of the Assembly addressed to the Constitution.
The judicial review for Olta Xhaçka's mandate was closed on June 25 and the MP won the case in the Constitutional Court, where the opposition claimed that Xhaçka violated the Constitution when she was a minister and her government gave her businessman husband, Artan Gaçi, the status of a strategic investor for a resort in Himara.
