Commissioners want to become judges: The request of 12 members of the KPK for
Commissioners want to be judges

12 Independent Qualification Commissioners ask the High Judicial Council to appoint them as judges in the Court of Appeal in Tirana.

The request was submitted after the closing of the triple control of 805 judges and prosecutors that started in the first instance in March 2018 and was closed recently, that is, shortly before the mandate of the commissioners that expires on December 31, 2024.

Through a letter, the vetting commissioners, who will start emptying their offices in a matter of days, which means that together with more than 30 councilors will be out of work, bring to the attention of the government of the judiciary not only obedience to the constitution. But they remember the work he performed during these years.

"We are convinced that we have fulfilled a great mission for the country, we have had the privilege of a High judge and the obligation against hundreds of reports and proceedings to answer before the law", the commissioners state in their request.

Anila Hoxha reports that not only that, but as in the two previous requests, they consider the possibility of legal changes, leaving open the possibility that the KLJ will turn to the constitutional court for constitutional interpretation on the status of a court created by law as KPK is considered.

"Today we are confident that our expectation is legitimate and will be guaranteed by regular legal actions by the state, ensuring our appointment as judges in the Appeal, as a process independent of the will of political parties through the voting of new legal norms, but based on objective criteria that guarantee legal certainty and the rule of law", it is argued, among other things.

At the end of the mandate of the commissioners, it does not mean that the vetting process ends here. The triple reassessment will continue in the Special College of Appeal, where all those dismissed have appealed, or some judges and prosecutors who were seen without problems by the KPK have been appealed by the Public Commissioner.

ONM monitors will continue as observers in KPA, while the role of commissioner will be taken by the chief prosecutor of SPAK, Altin Dumani./TCH
