Lawyer Ylli Manjani commented today with a note on Facebook the statements of Stela Gugallja's lawyer that the case against his client was tried once. Manjani explains why SPAK is committing a constitutional violation.

Manjani remembers that judging something that has already been judged has not been allowed for 2000 years. The former minister warns that this constitutes a danger for all citizens who tomorrow may find themselves in the same situation as Gugallja, to be tried twice for the same case only to be misled by SPAK in the name of "popular justice".

Meanwhile, Bledar Dervishaj, former legal advisor of Ilir Meta when the latter was President, intervened in the debate. Taking the case of the late Enver Sheshi as an example, Dervishaj points out that SPAK has put people in prison by mistake.

"We can recall another even more serious case, the late Enver Sheshi was arrested and imprisoned for fiscal evasion and the creation of VAT schemes in the criminal file of the incinerator in Fieri. He presented to the Prosecutor's Office and the Court the decision of the Tirana Court's conviction for the same fact and criminal offense with which he was convicted and he had redeemed it. Neither the Court of First Instance nor the Court of Appeal took him into account, while 10 days after the appeal decision, he died in prison", writes Dervishaj.
