The discussions on the new expertise carried out for the Arbri road works carried out by the "Gjoka" company, which were used as similar works in the competition for the 19 million euro tender of the Skërfica tunnel on the Kardhiq-Delvinë road in 2019, were concluded. on Tuesday, November 5, after the few questions of the parties in the criminal process against the former director of ARRSH, Sonila Qato and some of her subordinates, were exhausted.
Qato and other ARSH officials are accused of favoring a shadow company in the 19 million euro tender for the Skërfica tunnel on the Kardhiq-Delvinë road in 2019, disqualifying the "Gjoka" company based on an expert opinion on the works carried out until then on Arbri Street. However, after reporting Qato and her subordinates, "Gjoka" managed to win the tender. Qato and the other defendants deny the charges and demand that the company "Gjoka" be held criminally liable.
The new expertise was carried out after an act carried out by experts appointed by the former Serious Crimes Prosecutor's Office in 2019 was deemed invalid and unusable, due to the fact that one of the experts had been convicted.
Prosecutor Elvin Gokaj, who represents SPAK in the trial of this case, asked the experts what the results of the works carried out by the company "Gjoka" on Arbër street have been.
The experts stated that it turned out that 79.91% of the works in the three tunnels were completed.
The lawyers asked if hidden works, which are not visible, are also included in this calculation. The experts emphasized that they considered the masked works 100%, since they cannot ascertain them. According to them, without those works it is not possible to continue with the others.
Qato's legal representative, lawyer Vladimir Meçe, asked the experts to specify whether there were completed works in 2019. The experts stated that they found that 79.91% of the works were completed, but that there were no completed works.
Subsequently, in response to the lawyers' questions, the experts said that the tables of unfinished works in the two reports drawn up by ARRSH are the same.
After the parties had no objections or other positions related to the new expertise, the court found the conclusion of this stage of the trial and allowed the experts to leave the room.
Subsequently, the court rejected as unfounded a request of the company "Gjoka", to be asked about the act of technical expertise for the works in the three tunnels on the Arbri road, which in 2019 it submitted to the tender as works similar. The chairperson of the trial body, Irena Gjoka, said that the court has fulfilled all legal obligations and that the "Gjoka" company, as a victim, has the right to appear at the hearing whenever it evaluates it.
At the prosecutor's request for more time to present new evidence in the trial, if there will be any, the court decided to postpone the hearing until November 19, at 09:30. /Reporter.al
