The Constitutional Court has rejected the Democratic Party's request for the Academy of Sciences Law.
The court did not have the majority to overturn the law, as the judges were divided in a 4-4 tie.
The request to the Constitutional Court was submitted on May 10, 2024 by 37 opposition MPs led by Ina Zhupa.
The judges were divided into two positions, 4 judges assessed that the law should be repealed immediately because the meeting of the Education and Public Media Commission was called in violation of the Constitution and not proceed with the other points, while the other 4 judges assessed this claim as unfounded and requested the review of the other claims on the merits.
For the DP, the law was passed in complete violation of parliamentary procedures, trampling on legislative power and violating the constitution, according to them.
"Also, the law does not respect academics because it does not guarantee their equality before the law. Either all academics over 75 years of age can be elected or none. Or all academics over 75 years of age become emeritus or none. There cannot be legal definitions of "all except one" precisely the president for whom the law is tailor-made," Zhupa had declared.
