The Constitutional Court has accepted the request of the deputy of the Democratic Party, Dashnor Sula, who a short time ago requested the abolition of the Transparency Board for Basket Prices. 

According to the Constitution, the decision was taken because the condition of the normative act with the force of law is not fulfilled.

However, the Transparency Board for the setting of fuel prices is still in force even though it has received the greatest criticism regarding price abuse.

Decision :

The Constitutional Court examined in a public plenary session the request of no less than one fifth of the deputies of the Assembly of Albania, with the object: "Repeal of law no. 41/2022, dated 21.04.2022 "On the approval of the normative act, with the force of law, no. 7, dated 18.03.2022 of the Council of Ministers "On transparency and price monitoring for some basic food products and other related products as a result of the special situation created in the market", as incompatible with the Republic of Albania . Repeal of law no. 51/2022, dated 09.06.2022 "On the approval of the normative act, with the force of law, no. 9, dated 11.05.2022 "For an addition to normative act no. 7, dated 18.03.2022 of the Council of Ministers,

Regarding this issue, the Court assessed that the normative acts with the power of law no. 7, dated 18.03.2022 of the Council of Ministers "On transparency and price monitoring for some basic food products and other related products as a result of the special situation created in the market" and no. 9, dated 11.05.2022 "For an addition to normative act no. 7, dated 18.03.2022 of the Council of Ministers, "On transparency and price monitoring for some basic food products and other related products as a result of the special situation created in the market"" do not meet the constitutional criteria provided in Article 101 of the Constitution.

For this reason, the Constitutional Court of the Republic of Albania, based on articles 131, point 1, letter "c" and 134, point 1, letter "c", of the Constitution, as well as article 49, point 1, of law no. 8577, dated 10.02.2000 "On the organization and functioning of the Constitutional Court of the Republic of Albania", amended, by majority vote,

DECIDED:
1. Acceptance of the request.
2. Repeal of law no. 41/2022, dated 21.04.2022 "On the approval of the normative act, with the force of law, no. 7, dated 18.03.2022 of the Council of Ministers "On transparency and price monitoring for some basic food products and other related products as a result of the special situation created in the market", as incompatible with the Constitution of the Republic of Albania.

3. Shfuqizimin e ligjit nr. 51/2022, datë 09.06.2022 “Për miratimin e aktit normativ, me fuqinë e ligjit, nr. 9, datë 11.05.2022 “Për një shtesë në aktin normativ nr. 7, datë 18.03.2022 të Këshillit të Ministrave, “Për transparencën dhe monitorimin e çmimit për disa produkte ushqimore bazë dhe produkte të tjera të lidhura me to si pasojë e situatës së veçantë të krijuar në treg”””, si i papajtueshëm me Kushtetutën e Republikës së Shqipërisë.
Ky vendim është përfundimtar dhe hyn në fuqi ditën e botimit në Fletoren Zyrtare.

Vendimi përfundimtar do të shpallet i arsyetuar brenda afateve ligjore të parashikuara nga ligji nr. 8577, datë 10.02.2000 “Për organizimin dhe funksionimin e Gjykatës Kushtetuese të Republikës së Shqipërisë”, i ndryshuar dhe nga Rregullorja për Procedurat Gjyqësore të Gjykatës Kushtetuese.’- njofton Gjykata.
