The bill of the International Courts in the state budget is increasing year after year as a result of the mistakes made by the Albanian government in contractual financial relations with companies and individuals.

The Ministry of Finance reported that by the end of June 2023 the total bill to be paid from the budget in June 2023 reached 214.4 million euros, of which 21.7 million euros are the decision of the International Court of Human Rights and are mainly in favor of the former owners and another 192.7 million euros derive from the decisions of the International Court of Arbitration that are investors who had contracts with the government.

As can be seen from the following tables published by the Ministry of Finance, from the total of 192.7 million euros for the Arbitration decisions, the one for the Becchetti case is much higher.

The Albanian government has accepted as a liability the trial won by Becchetti with the case "Hydro and others against Albania" with a value of 108 million euros, but Finances have reported it as a liability but have not invoiced it. The company, on the other hand, has been applying the sequestration instrument on the accounts of the Albanian government abroad for years. In addition to the obligation, there are 5.1 million euros in legal costs for this arbitration.

The second highest liability is that of the Greek road company Copri Actor to the Albanian Road Authority (ARRSH), with 42.9 million euros.

The third highest known obligation is that of GBC OIl Company to the Ministry of Industry and Energy, AKBN and Albpetrol, with 13.4 million euros. These three institutions also have legal costs of almost 8 million euros for the representation procedures for two cases.

In total, only the legal costs for the defense of various cases in the Arbitration have reached about 26 million euros.

The Ministry of Finance pointed out that the decisions of the Arbitration are related to the final decisions for the resolution of conflicts in bilateral or multilateral disputes, in charge of the Albanian state. Considering the inherent financial effects that usually accompany these decisions, they are assessed as a significant risk for the state budget.

According to the Ministry of Finance, for the most part, the financial effects resulting from the implementation of these decisions have been borne by the budget of the budgetary institutions themselves (mainly the line ministry), which have also been defendants in the relevant trials. Meanwhile, in cases where the sued party is described as the 'Albanian state' or the 'Albanian government', these decisions are liquidated through the budget of the MFE and/or the Reserve Fund of the state budget, if the need arises.

"MFE, continuously and persistently, has recommended strengthening the negotiating role of budgetary institutions and the State Attorney's Office in matters of this nature, as well as disciplining the process of financial settlement of the beneficiaries. This, with the final goal of easing, reducing and/or avoiding the financial burden on the state budget," emphasized the Ministry of Finance.
