Veliaj's fate in Begaj's hands, here's what's expected to
Erion Veliaj/Bajram Begaj

The government, with the signature of the Secretary General, Engjëll Agaçi, notified President Bajram Begaj on Tuesday morning about the vacancies created in 6 municipalities, led by Tirana, thus moving forward with the holding of early partial elections.

"The Council of Ministers has been informed of the creation of mayoral vacancies in several municipalities in the country, namely the municipalities of Tirana, Vlora, Berat, Tepelena, Mat and Cerrik, and consequently, it is requested to set the date for partial mayoral elections in these municipalities within the deadlines set by the electoral law," the Council of Ministers declares.

Constitutionalist Bledar Dervishaj, on the Albania Live show on Top Channel, initially explained the timing of when the president will have to respond with a decree to the government's announcement.

"Within 48 hours of receiving this notification, he will have to issue a decree setting the election date ," Dervishaj said.

But the presidential decree faces a legal complication of a constitutional nature, as the dismissed mayor of Tirana, Erion Veliaj, has already appealed the Government's decision to dismiss him to the Constitutional Court.

A few hours after the government's request to the presidency was learned, the Constitutional Court took care to clarify its position by stating that:

"The only answer that the Constitutional Court has given regarding the case with no. 28(E) Basic Register, dated 29.09.2025, is that the Court has published the registration of the request. The announcement is equivalent to public notice ," the Constitutional Court declared.

Erion Veliaj's lawyers appealed to the Constitutional Court based on Article 115 of the Constitution, which provides that:

“The directly elected body of the local government unit may be dissolved or dismissed by the Council of Ministers for serious violations of the Constitution or laws. The dissolved or dismissed body may appeal to the Constitutional Court within 15 days, and in this case the decision of the Council of Ministers shall be suspended.”

According to lawyer Dervishaj, point two of this article prohibits the president from decreeing elections in Tirana.

"The election date will be set only after you have received information from the Constitutional Court and they provide it within the hour, that there is an appeal and if so, a copy of it. And the election date will be set for those vacancies that we do not have an appeal process with the Constitutional Court. The rest is regulated by the electoral code, as well as the deadlines for when its review will be completed ," said Dervishaj.

The expectations are that President Bajram Begaj will decree elections in all six municipalities, including Tirana, since the report sent by the government for Veliaj's dismissal is not related to the first point of Article 115 of the Constitution, when an elected official is dismissed for serious violations of the Constitution or laws, but that Mr. Veliaj was dismissed based on the law on local government, which states that if an elected official is absent for 90 days, the municipal council proposes dismissal.
