NAME/ Murder for brandy in Lushnje, the 57-year-old is sentenced to life

The Court of Appeal of General Jurisdiction has sentenced 58-year-old Sofokli Shani to life imprisonment, who shot dead Irakli Qorri and injured his son, an event that occurred on June 4, 2021, in a bar in the village of Fier i Ri.

A momentary conflict that started in a bar ended with the killing of a 62-year-old man and the wounding of his son.

Rako Qorri and his son, Kejdi Qorri, 31 years old, were shot with a Kalashnikov in the premises of the bar they owned.

The 62-year-old man died on the spot from the shooting, while his son was transported to the hospital in critical condition.

As a suspected perpetrator, the police arrested 58-year-old Sofokli Shani from the village of Krutje e Sipërme, while also seizing the firearm with which he is believed to have committed the crime.

It is learned that the victim together with his son had an argument with the 57-year-old in the premises of their bar.

The author had asked to drink alcohol, which was refused by the victim, owner of the bar Rako (Irakli) Qorri.

Then a fight started between them, as Sofokli Shani hit the owner of the bar. The sons of Rako Qorri, who raped Sofokli Sahni, have arrived to help.

The latter went home, took the gun, returned to the bar and shot at Rako Qorri and his sons.

DECISION OF THE COURT

Referring to previous reports in the media, the Court of Appeal of General Jurisdiction informs the following:

On 02.06.2021 at around 20:30, the operating room of the Lushnja Police Station was informed that in the village of "Fier i Ri, Krutje Administrative Unit, there were gunshots, as a result of a momentary conflict with the owner of the bar , the citizen with the initials Sofokli Shani shot with a firearm, where the citizen with the initials RQ (the owner of the bar) was killed on the spot, and his son, the citizen with the initials KQ, was injured

In the Lushnjë Judicial District Court, a trial was held regarding the criminal case that belongs to the defendant with the initials Sofokli Shani, accused of committing the criminal offenses of "Murder in Other Qualifying Circumstances" as well as "Unauthorized Possession and Production of Weapons, explosive weapons and ammunition", provided by articles 79/dh and 278/1/3 of the Criminal Code.

Gjykata e Rrethit Gjyqësor Lushnjë me vendimin nr. 399 (2380), datë 16.12.2022 ka vendosur:

1. Deklarimin fajtor të të pandehurit S.Sh, për kryerjen e veprës penale të “Vrasjes në rrethana të tjera cilësuese”, parashikuar nga neni 79/dh i Kodit Penal dhe në bazë të kësaj dispozite, dënimin e tij me burgim të përjetshëm.

2. Deklarimin fajtor për veprën penale “Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”, parashikuar nga neni 278/1 i Kodi Penal dhe dënimin me 6 (gjashtë) vjet burgim.
3. Deklarimin fajtor për veprën penale “Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”, parashikuar nga neni 278/3 të Kodi Penal dhe dënimin me 1 (një) vit e 6 (gjashtë) muaj burgim.
4. Në aplikim të nenit 55 të Kodit Penal, në bashkim të dënimeve, i pandehuri Sofokli Shani dënohet me burgim të përjetshëm.

Çështja në apel u shqyrtua mbi bazën e ankimit të bërë nga i pandehuri me iniciale Sofokli Shani, i cili kërkoi:

– Ndryshimin e vendimit në raport me kualifikimin e veprës penale, duke kryer cilësimin juridik në atë të parashikuar në nenet 76, 278 dhe 91 të K.Penal.

– Revokimin e vendimit për mospranimin e gjykimit të shkurtuar duke aplikuar nenin 403 të K.Pr.Penale, duke zbritur një të tretën e masës së dënimit, në bazë të dënimit që do të caktohet nga gjykata.

Në përfundim të gjykimit, më datë 30.05.2023, Gjykata e Apelit të Juridiksionit të Përgjithshëm, e përbërë nga trupi gjykues me Relator Gjyqtar z. Valbon Çekrezi dhe anëtare znj. Edlira Petri dhe z. Fatri Islamaj, vendosi:

– Lënien në fuqi të vendimit penal nr. 399/2380, datë 16.12.2022, të Gjykatës së Rrethit Gjyqësor Lushnjë për sa i përket:

– Deklarimit fajtor të të pandehurit Sofokli Shani për kryerjen e veprës penale të parashikuar nga neni
79/dh i Kodit Penal.

– Deklarimit fajtor të të pandehurit S.Sh dhe masës së dënimit të dhënë për veprën penale të parashikuar nga neni 278/1 te Kodit Penal;

- The guilty declaration of the defendant Sofokli Shani for committing the criminal offense provided for by Article 278/3 of the Criminal Code;
-Disposition on material evidence, serving the sentence and dispositions for procedural costs.

- The amendment of the criminal decision no. 399/2380, dated 16.12.2022 of the Lushnja Judicial District Court in the rest as follows:
- The sentence of the defendant S.Sh based on Article 79/dh of the Criminal Code with 30 (thirty) years of imprisonment.

- Pursuant to Article 55 of the Criminal Code, in the consolidation of the sentences, the final sentence of the defendant Sofokli Shani with 33 (thirty-three) years of imprisonment.
