The three experts assigned by the Special Court of First Instance to carry out a new expertise related to the works on the Arbër road carried out by the company " Gjoka ", which were used as similar works in the competition for the 19 million euro tender for the tunnel Skërfica on the Kardhiq-Delvinë road in 2019, submitted on Tuesday, October 29, their answers to the questions raised by the prosecutor of the case, Elvin Gokaj .
The former director of ARRSH, Sonila Qato and some of her former subordinates are accused of favoring a shadow company in the 19 million euro tender of the Skërfica tunnel on the Kardhiq-Delvinë road in 2019, disqualifying the "Gjoka" company based on an examination of the works carried out until then on Arbër Street.
However, after reporting Daj Qato and her subordinates, " Gjoka " managed to win the tender.
Qato and the other defendants deny the charges and demand that the company " Gjoka " be held criminally liable.
The new expertise was carried out after an act carried out by experts appointed by the former Serious Crimes Prosecutor's Office in 2019 was deemed invalid and unusable, after allegations were made by the defendants that the experts appointed by the prosecution body were unlicensed and that one of them has been convicted of forgery.
The fact that one of the experts had been convicted was also established by the court that assessed the initial act as unusable.
As in the session of September 17, the experts stated that the works in the three tunnels of Rruga i Arbër were unfinished when such sites were approved in 2019.
They did not read the prosecutor's questions, but presented the answers in a summary manner, emphasizing that each question found an explanation. The experts gave details about the percentage of completed works.
According to them, " Gjoka " had completed about 79.9% of the works, while even now the tunnels have not become usable since not all the works have been completed.
The experts said that there are differences regarding the findings on the construction works carried out by the ARSH and the previous expertise of the prosecutor's office.
Prosecutor Elvin Gokaj said that this act of expertise does not bring anything new. He asked for time to give his opinion regarding the findings of the experts.
The lawyers described as unrelated to the case the accusation's questions to compare the ARSH report with the previous expert report requested by the prosecution, arguing that this report is now unusable.
They emphasized that it is understandable that the works were not completed in 2019, while they continue to be completely unfinished in 2024. According to them, the "Gjoka" company has submitted a similar unfinished work in the tender procedure for the Skërfica tunnel on the Kardhiq-Delvinë road, attempting to benefit from public funds through the fraud of the ARRSH.
Prosecutor Elvin Gokaj pointed out that this expert report is not the only evidence in this criminal process, but that there are also trips, emails, testimonies, etc.
During the session, it was announced that the " Gjoka " construction company had requested the expert report from SPAK , providing it, as well as requested the court to exclude the experts, claiming that they did not meet the criteria for conducting such an expert report.
The request of the company "Gjoka" was rejected by the court, which decided to postpone the hearing until November 5 at 10:00, in order to give the prosecutor time to prepare his position against the answers given by the experts./ Reporter
