Judge Esmerilda Habili of the Court of Vlora faced without problems on Friday, April 7, 2023, the Independent Qualification Commission, KPK, when from what was reported in the hearing, it was learned that the burden of proof had not been passed in any of the revaluation criteria, but only explanations were asked for two issues examined by her.

The vetting process for Habil is being carried out by the KPK body headed by Alma Faskaj, with rapporteur Pamela Qirko and member Xhensila Pinen. Willem Brower was present as an international observer.

Esmerilda Habili completed her studies at the Magistrate's School in 2015 and after a period of internship at the Court of Tirana, she was appointed a judge at the Court of Vlora. In 2020, she was appointed to the unit of professional and ethical evaluation of judges in the High Judicial Council.

Reporter Qirko clarified that from the investigation carried out for two bank accounts opened for the salary and apartments rented by the subject during the period of exercise of the duty, no problems were found. According to the reporter, an in-depth investigation was carried out beyond Habil's statements, but no assets, real rights, or any data for further investigations were identified.

From the financial analysis carried out for the period 2014-2016, it was found that Habili had legal resources to cover vital expenses.

Habil received positive evaluation for the purity of the image. In the professional aspect, it was said that he was asked for explanations for two of the four denunciations, two of which were repeated by the same person.

In one of Habil's decisions, it was found that she did not determine the electronic surveillance mechanism for a person to whom she assigned the security measure of "house arrest". Habili explained that he had proven with documentation that in that period the electronic surveillance did not work and that is why he had determined surveillance by the judicial police.

For the other issue, the whistleblower raised allegations of violation of the adversarial principle in the trial. The subject stated that in this case it was based on the practice of the Constitutional Court.

She explained that it was a decision of the Commission for the Return and Compensation of Properties and that the court had been obliged to investigate the legality of this title beyond the falsity, in order to resolve the issue once and for all.

In conclusion, judge Esmerilda Habili asked for confirmation in office. KPK announced that the decision will be announced on April 11, at 09:45./reporter.al
