Journalist Adriatik Doçi appealed to the Special Court the decision of SPAK prosecutor Alfred Shehu, who decided not to initiate criminal proceedings against two of his colleagues, Klodian Braho and Ened Nakuçi, for concealing evidence implicating former minister Arben Ahmetaj in the affair of the incinerators, as were the luxury hotel bills paid by businessman Klodian Zoto.

The news was announced by Doçi himself through a post on social networks, where he writes that the prosecutor Alfred Shehu made the decision in a record time of 13 days and without conducting any verification.

The journalist describes this decision as a deepening of the scandal and that the prosecutor Alfred Shehu, instead of carrying out a basic verification of the claims in the report, has made an unprecedented essay, talking about psychological issues, feelings, knowledge and conviction internal affairs of the two prosecutors.

In his post, Adriatik Doçi also lists the questions that were not answered by the prosecutor Alfred Shehu on the concealment of evidence by the prosecutors of SPAK, Klodian Braho and Ened Nakuçi about Arben Ahmetaj and not accepting the latter as a defendant.

Today I appealed to the Special Court against Corruption and Organized Crime the decision of the SPAK prosecutor, Alfred Shehu, who, without carrying out any verification and in a record time of 13 days, decided not to initiate criminal proceedings for his two colleagues, Klodian Braho and Eneid Nakuçi, reported by me for misuse of duties and actions that prevent the discovery of the truth about the incinerators issue.

Klodian Braho and Eneid Nakuçi, abusing their duties, undermining equality before the law, defending corruption at high levels and undermining the public's trust in SPAK, have hidden the criminal facts implicating former minister Arben Ahmetaj in the so-called incinerator affair, diverting investigations and second-level officials charged with criminal responsibility.
The facts are Klodian Zoto's corrupt payments worth thousands of euros to cover Arben Ahmetaj's accommodation expenses in 5-star hotels in Europe, after Ahmetaj had signed the incinerator concession, where the company owned by Klodian Zoton was the beneficiary.

Pagesat kompromentuese janë zbuluar nga rikuperimi i të dhënave nga hetuesit në 3 kompjuterat dhe telefonin e Zotos. Pagesa të së njëjtës natyrë janë bërë pjesë e dosjes hetimore për Etleva Kondin, ish drejtoreshë e koncensioneve në Ministrinë e Energjitikës dhe anëtarë e Komisiomit të Vlersimit të Ofertave për inceneratorët e Elbasanit dhe Fierit. Kondi është marrë e pandehur nga SPAK.

Çuditërisht, të njëjtat pagesa, të zbuluara në të njëjtët kompjutera për Arben Ahmetaj, jo vetëm nuk janë pjesë e fashikujve hetimorë, por janë mbuluar dhe zhdukur me qëllim për të shpëtuar nga përgjegjësia penale ish ministrin, i cili po del se është pronari real i incenetatorëve.

Ligji penal dhe procedural penal është zbatuar për ish zyrtaren e nivelit të mesëm Etleva Kondin, por jo për zyrtarin e nivelit të lartë Arben Ahmetajn. I vetmi fakt flagrant korruptiv në historinë e çështjes së inceneratorëve ishin pagesat e Klodian Zotos. Pikërisht fakti më i rëndësishëm është fshehur.

Skandali u thelluar nga Prokurori i SPAK, Alfred Shehu, i cili në vend që të kryente një verifikim elementar të pretendimeve në kallëzim, ka bërë bërë një ese të paprecedentë, duke folur për çështje psikologjike, ndjesi, kompeteca të ditura dhe bindje të brendshme të dy prokurorëve.

Një proces hetimor nuk është një hartim, subjekt letrar apo përshtjellim ndjenjash. Nuk është as riptodhim nenesh.
Pa kryer asnjë veprim verifikues, prokurori Alfred Shehu thotë se fakti i fshehjes së provave nga dy prokurorët nuk ekziston, se çështja është nën hetim dhe se dy prokurorët kanë krijuar bindjen e brendshme për të mos marrë nën hetim Arben Ahmetajn.

1. Prokurori Alfred Shehu flet në vendimin e tij për kompetencat e prokurorëve, hetimet dhe bindje të brendshme. Thelbi i kallëzimit nuk ka të bëjë me hetimet dhe as kompetencat, por me fshehjen e fakteve të reja nga dy prokurorët Klodian Braho dhe Eneid Nakuçi.

2. Prokurori Alfred Shehu thotë se janë ndarë hetimet në shtator 2022 për verifikimin e përgjegjësisë penale të zyratëve dhe ish zyrtarëve të tjerë. Jo vetëm Arben Ahmetaj, por as Ministria e Ekonomisë nuk figuron në ndarjen e procedimit në shtator 2022.

Nuk ka përgjigje:

Çfarë provash janë gjetur nga kompjuterat e Klodian Zotos? Cilat prova janë përfshirë në fashikullin hetimor dhe cilat jo?
Pse pagesat e Zotos për Etleva Kondin janë përfshirë në doje, ndërsa pagesat për Arben Ahmetajn nuk janë përfshirë?
Pse nuk pyeten dy prokurorët Klodin Braho dhe Eneid Nakuçi se çfarë kanë bërë me faktin e pagesave të Zotos për llogari të Ahmetajt?
Çfarë veprimi ndërmorrën kur u njohën me këtë fakt dhe cili ishte vlerësimi i tyre?
Pse Ministria e Energjitikës dhe e Drejtësisë janë përfshirë në ndarjen e procedimit të shtatorit 2022, ndërsa ministritë e Financave dhe Ekonomisë, të drejtuara nga Ahmetaj nuk janë përfshirë, kur në proces kanë marrë pjesë të gjitha?
Why is the case of incinerators not investigated together, by a group of prosecutors, but is divided into different branches from time to time, turning the investigation into a soap opera.
Are the two prosecutors serving Ahmetaj, Ilir Meta and Lulzim Basha, destroying the investigation into the incinerators case, to save heads?
What else needs to happen for the two prosecutors of the case to be replaced and the investigations to be restarted from the beginning, without hiding evidence and witch hunting?!
