The Special Court of First Instance for Corruption and Organized Crime announced on Tuesday, June 17, the decision to declare guilty the former head of the Tirana Parking entity under the Municipality of Tirana, as well as four other officials of this institution, accused of illegally favoring a company owned "de facto" by the former head of the Water Supply Company, Redi Molla, and that of the IMT, Mariglen Qato, by feeding it with public tenders.
The former general director of the Tirana Parking institution, Eglantina Zere, and four other Tirana Municipality officials, Rivjola Baxha, Enkelejda Qyta, Bruno Koçi and Kristo Zhulati, were held criminally liable for the charge of "Violation of equality of participants in public tenders or auctions."
According to SPAK, during the preliminary investigations, it was proven that the defendant Eglantina Zere, in the capacity of the head of the contracting authority "Tirana Parking", an institution subordinate to the Municipality of Tirana, in collaboration with the defendants Enkelejda Qyta, Bruno Koçi and Rivjola Baxha, in the capacity of members of the Bid Evaluation Commission and the member of the Procurement Unit, Kristo Zhulati, have created unfair advantages and privileges for the merger of the winning economic operators "VAS Konstruksion sh.pk" and "Rroku Guest" sh.pk, in the procurement procedure with the object "Reconstruction of the Selman Stermasi parking lot", held on October 1, 2019.
The prosecution noted in court that the evidence collected during the investigations fully proves the fact that the verification and evaluation of the offers of the economic operators that participated in this procurement procedure were not carried out by the members of the KVO, but by other persons who worked at the company "5D Konstruksion" sh.pk.
SPAK requested a guilty plea and sentence of Zere to 1 year in prison, which in the application of the summary trial is reduced to 8 months of imprisonment. For the other four defendants, a sentence of 9 months in prison was requested, which with the reduction of 1/3 of the measure remains 6 months. It was also requested that the sentence be suspended and that they be placed on probation. The defendants pleaded not guilty.
The court decided on Tuesday the same sentence as requested by the prosecution, where by applying the summary trial, the defendant Eglantina Zere was finally sentenced to 8 months in prison, while the other four were sentenced to 6 months each. Meanwhile, the request for suspension of the sentence was not accepted.
