The Ministry of Justice has reacted regarding the transfer of  Erion Veliaj from detention facilities, clarifying that the move to the Institution for the Execution of Criminal Decisions (IEVP) Fier was carried out within the framework of measures taken for the security and well-being of penitentiary institutions.

Through a press release, the institution emphasizes that upon arrival in Fier, standard admission procedures were applied to Veliaj, in accordance with the legislation in force on the rights and treatment of detainees.

One of the main points of reaction is related to the transfer order, for which the Ministry of Justice explains that it was approved according to standard procedures, but is part of the list of documents classified as "state secret".

For this reason, the administration and availability of the document are subject to the criteria and procedures established by the law on classified information.

The institution also announces that the prosecution body has been notified of Veliaj's transfer, in accordance with the legislation in force.

Full reaction:

Given the extensive media speculation, we decided to make this unusual press release regarding standard internal work procedures.

The transfer of citizen EV was carried out within the framework of the measures that the General Directorate of Prisons has recently taken to ensure the security and smooth functioning of the institutions for the execution of criminal decisions.

Following the transfer of pre-trial detainee EV to the Fier Penitentiary Institution, the admission procedures provided for in Article 38 of Law No. 81/2020, dated 25.6.2020, “On the rights and treatment of prisoners and pre-trial detainees”, as well as in Article 15 of the General Prison Regulations, approved by Decision No. 209, dated 06.04.2022, of the Council of Ministers, were implemented.

In accordance with Article 15, point 4, of the General Prison Regulations, on 28.10.2026, detainee EV was placed in the reception (observation) section and was treated correctly and in accordance with the legal framework as in all other cases.

On 29.10.2026, the responsible structures of the Fier Penitentiary Institution held a meeting with the pre-detainee EV in the observation sector. During the meeting, his claims were heard and clarifications were given on his rights and obligations regarding his stay in the institution. In conclusion, the admission committee continued with his full placement, in accordance with the individual assessment and relevant procedures.

As for the transfer order, which is being speculated about in particular in the media, this act was adopted in accordance with standard procedures and is included in the list of documents classified as “state secret”. Consequently, its administration, recognition and making available are subject to the conditions, criteria and procedures provided for in Law No. 10/2023, “On Classified Information”, and in the sub-legal acts issued in its implementation.

We add that in the case of detainee EV, the prosecution body was also notified, in accordance with the requirements of the legislation in force.

In accordance with Article 78 of Law No. 81/2020, “On the Rights and Treatment of Prisoners and Detainees”, as well as Articles 106–108 of the General Regulation of Prisons, approved by Decision No. 209, dated 6.4.2022, of the Council of Ministers, the transfer order for any justified reason is issued by the Director General of Prisons. The assessment and decision-making on the transfer are included in the competence and administrative discretion of the Director General, as a normal working practice exercised within the legal conditions and criteria, on the basis of the administered documentation.

From 16.10.2026 to 27.10.2026, 24 (twenty-four) transfers were carried out by the DPB within the legal framework.

The General Directorate of Prisons continues to take the necessary measures to guarantee security, prevent incidents and ensure the smooth running of institutions, while respecting the rights and dignity of imprisoned persons.
