During the presentation of the amendments to the Criminal Procedure Code, Prime Minister Edi Rama said that the police and prosecution can seize a device, but court authorization will be required to open and check its contents, which must determine the data, applications and period that can be reviewed.
He also emphasized that data obtained outside of this authorization will be considered unusable.
Rama: "The phone is not simply a means of communication, but an archive of a person's life. Seizing the device cannot be an unlimited license to read and view everything it contains. The police and the prosecution can seize the device, but to open, copy or process the contents of the phone, authorization from the court is required. A court decision determines the device, the category of data, applications, period and search criteria. Any data obtained outside of authorization is unusable. The same logic is used for wiretapping. Only wiretapping related to investigations should be transcribed. The private lives of people unrelated to the criminal offense cannot be turned into an instrument of pressure or a product of media consumption.
