The Democratic Party has declared its vote in favor of the agreement to admit Albania to the Charter of the Peace Board , but has proposed an amendment to remove Prime Minister Rama's name from its title.
The head of the DP group, Gazment Bardhi, writes that " the Republic of Albania is represented in international organizations by institutions, not by individuals ."
He has proposed that Albania be represented in this institution by the President of the country and only with the latter's authorization by the Prime Minister.
DP amendments:
In order to guarantee the constitutionality of the draft law "On the ratification of the Accession Agreement of the Republic of Albania, represented by Prime Minister Edi Rama, to the Charter of the Peace Board", we assess that it is necessary to make some changes to its content, in accordance with Article 121 of the Constitution and Law No. 43/2016.
The Republic of Albania is represented in international organizations by institutions, not individuals. For this purpose, reference should be made to the institution, not to individuals.
It is unprecedented in the history of Albania and international law that accession or acceptance of an international agreement is never done with specific names.
DEMOCRATIC PARTY PARLIAMENTARY GROUP – ASSEMBLY OF ALBANIA
For all the arguments above, in support of Articles 71 and 75 of the Regulation, I propose the following amendments:
Amendment 1:
The title should be reformulated:
"On the ratification of the accession agreement of the Republic of Albania to the Charter of the Peace Board".
Amendment 2:
Article 1 is amended as follows:
"Ratification of the accession agreement of the Republic of Albania to the Charter of the Peace Board, according to the text attached to this law and forming an integral part thereof."
Amendment 3:
After Article 1, Article 2 is added, with the following content:
“In accordance with Article 2.2, letter 'a' of the Charter of the Peace Board, the Republic of Albania shall be represented on the Peace Board by the President of the Republic or, upon his authorization, by the Prime Minister of the Republic of Albania, in accordance with the powers recognized by the Constitution and the legislation in force for international agreements in the Republic of Albania.”
The above, in accordance with Articles 71 and 75 of the Rules of Procedure of the Assembly, I propose the consideration and approval of the above amendments.
