Ylli Manjani has commented on the arrest of Tirana Mayor Erion Veliaj on SPAK orders.
Manjani has described Veliaj's arrest as an unacceptable action, emphasizing that he was detained without facts and evidence and that there are no official charges against him.
"First, both from the journalist's description, but also from the SPAK announcement, we understand that Erion Veliaj is not a defendant. This means that there are no official charges against this person. What we have discussed, and I have been and am the only one who can have this thesis, is that the person under investigation is not a defendant.
"Defendant means that the state has officially charged you, and this happens when there is evidence against you, the accusation requires evidence, not talk. Today, there are no charges against the person under investigation, which means that SPAKU has not yet collected evidence to have a defendant," Manjani said on the "Now.
He also called it unacceptable to detain a person without formal charges, emphasizing that he has stood by this principle for 15 years.
"A person cannot remain in detention for two years without charges. This happened not only to Erion Veliaj, but also to Prime Minister Rama, I will say the same thing, because this applies to everyone. A serious state, when it charges you, puts you in prison. There is no reason to arrest you if you have suspicions that he may tamper with evidence. You can remove him from duty and from office, but not arrest him ," added the former Minister of Justice.
Manjani also stressed that, if SPAK had evidence, it would have taken Veliaj directly to trial, but since it has not done so, this shows that the charges are not sufficient to make him a defendant.
"If SPAK had evidence, in that notification, then it would be a defendant and would take him directly to court. But the fact that it does not do this means that it is not ready to do this ," he said.
The lawyer added that he is against disproportionate and extreme security measures, which he sees as a poor standard in criminal justice.
"I have been, am and will be like this, as long as we have a poor standard in criminal justice, I believe, in the European space."
Manjani also mentioned the possibility that Veliaj could risk up to 36 years in prison just for passive corruption charges, emphasizing that it is strange that these events happen to people from the Socialist Party.
He also mentioned that several other people who were under investigation had been held in detention for more than three years, without any concrete charges being brought against them.
"He can stay in detention for 1 or 2 years, theoretically 1 year is the average, but they can take him two. This same SPAK, a few months ago, released 32 people after their terms had expired. They were under investigation without trial yet, but they spent 3 years in detention ," Manjani concluded.
