The President of the Constitutional Court, Holta Zaçaj, says that the non-implementation of the decision of this court for the mandate of the former Minister of Foreign Affairs, Olta Xhaçka, is an unusual situation.
"It is really an unusual and impossible situation to happen in a democratic state. The decisions of the Constitutional Court must be implemented and the implementation of the decisions of the Constitutional Court constitutes in fact the implementation of the Constitution itself. Words are too much to convey any more message. Every decision must be implemented, there is no other way, there is no other mechanism, and the reason why there is no other mechanism is because it is impossible to imagine that the decisions of the Constitutional Court will not be implemented. The institutions that are charged with implementing the decisions of the Constitutional Court must behave in a constitutional manner", said Zaçaj in an interview for the Voice of America.
She also affirmed that during the meetings with senior officials in Washington DC, the most important and current issues of the Albanian judiciary and justice were discussed and the importance of the Constitutional Court in resolving the conflict of powers between state bodies was discussed in particular, in the final interpretation of the Constitution and the guarantee of respect for fundamental rights and freedoms.
Asked by the Voice of America journalist about the opposition's criticism of the decision-making on the issue of the agreement for immigrants with Italy, the President of the Constitutional Court stated that the dissatisfied parties have their right to criticism as a right to freedom of expression, which enables all actors to give their opinion.
She also spoke about the vote of immigrants, where she emphasized that "the court speaks with decisions, they must be implemented, it is not left up to politics to decide how and in what way the decisions should be implemented, they are self-executing".
"Any decision that does not coincide with that of the Constitutional Court is not the right decision or action. In every decision of the Court there are dissatisfied parties. The court acts hermetically. Judges are independent, they do not act under pressure".
