The Central Election Commissioner has decided not to register Enkelejd Alibeaj's DP as an electoral subject for the local elections of May 14, because it does not complete the documentation.

According to the chief commissioner Ilirjan Celibashi, the Democratic Party still has party leader Lulzim Basha and he should be the one who should sign the solemn declaration. While he finally decided not to legitimize Sali Berisha. 

"The DP's request to register in the elections has no legal basis and cannot be registered as an electoral subject," said Celibashi.

Among other things, the head of the CEC said that Alibeaj's group did not bring any additional documents even after the request of the CEC, as he argued his decision.

"At the moment we asked to complete the documentation and since there is no other document, I think we are in the same situation as we were last time. My assessment of the registration of the Democratic Party is as follows: The issue of legal representation has been discussed, and here I don't take your internal conflict into consideration. In the legal assessment I make of this documentation, there are several facts. The claim of one party that Lulzim Basha is the chairman of the DP is legally valid. It has not been established that Sali Berisha is the chairman. So, let's start from this fact, the party represented by Lulzim Basha has full legitimacy. In my opinion, Lulzim Basha or the persons represented by him can make the request.

This authorization must be complete in relation to the fees of the authorized person, the documentation for the registration of DP, as an electoral subject, presented by you, has a fundamental deficiency, the solemn declaration must be signed by Lulzim Basha and not by Enkelejd Alibeaj , in my belief based on the law, the statement should be signed only by the Party chairman, in my estimation, article 64, point 2, letter e, leaves no room for other interpretation. The provision does not leave room for interpretations, except for the fact that it is who for the registration of the party as an electoral subject. The President elected by the Assembly, the decision of the Assembly, does not automatically give him the right to exercise his office without taking an oath, it is a formal act, but not doing it does not allow the president to exercise his office, the same is true of the solemn declaration. The signature by Alibeaj was made on the basis of the authorization that Basha made on March 18, 2022, the DP representative claimed that Alibeaj has the right to sign the solemn declaration as well, this claim of yours has no legal basis, the solemn declarations of the president must subject only to the chairman. It is a personal commitment and cannot be transformed to others, the characteristics of the declaration clearly show that that document is an exclusive act of the chairman only, it cannot be delegated. The responsibility of the party chairman alone is the same as the responsibility of a witness in a judicial process, it cannot be transferred to third parties. If the commitment statement was allowed to be presented by another, then the legislator would not have taken care to define it as "solemn".

Ky autorizim duhet të jetë i plotë në lidhje me tagrat e të autorizuarit, dokumentacioni për regjistrimin e PD, si subjekt zgjedhor, i paraqitur nga ju, ka një mangësi themelore, deklarata solemne duhet të jetë e nënshkruar nga Lulzim Basha dhe jo nga Enkelejd Alibeaj, në bindjen time e bazuar në ligj, deklarata duhet të nënshkruhet vetëm nga kryetari i Partisë, në vlerësimin tim, neni 64, pika 2, germa e, nuk lë vend për interpretim tjetër. Dispozita nuk lë vend për interpretime, përveç faktit që është kush për regjistrimin e partisë si subjekt zgjedhor. Presidenti zgjidhte nga Kuvendi, vendimi i Kuvendit, nuk i jep atij automatikisht për drejtën për të ushtruar detyrën pa bërë betimim, është akt formal, por mos bërja e tij nuk e lejon presidentin që të ushtrojë detyrën, të njëjtën gjë mbart edhe deklarata solemne. Nënshkrimi nga Alibeaj është bërë në bazë të autorizimit që Basha ka bërë në 18 mars 2022, përfaqësuesi i PD keni pretenduar se Alibeaj e ka të drejtën të nënshkruaj edhe deklaratën solemne, ky pretendim i juaji nuk ka bazë ligjore, deklaratat solemne e kryetarit duhet të nënshtrohet vetëm nga kryetari. Është një angazhim personal dhe nuk mund të jetë e transformueshme te të tjerët, karakteristika e deklaratës, tregon qartë se ai dokument është akt ekskluziv vetëm i kryetarit, nuk mund të delegohet. Përgjegjësia vetëm e kryetarit të partisë është e njëjtë me përgjegjësinë e një dëshmitari në një proces gjyqësor, nuk mund të transferohet te të tretët. Nëse deklarata angazhuese do të lejohej të paraqitej dhe nga një tjetër, atëherë ligjvënësi nuk do ishte kujdesur që ta përkufizonte si “solemne”. “Për t’u regjistruar duhet të paraqesë në KQZ deklaratën nga kryetari i partisë", pra do të ” ishte evituar fjala “solemne”, nëse mund të delegohej si kompetencë.

Ju thatë që Lulzim Basha ka dhënë dorëheqjen dhe nuk mund ta firmoste deklaratën.  Bie në kontradiktë me veprimet konkrete të bëra nga ana juaj. Sipas jush nënshkrimi i kësaj deklarate nga i autorizuari prej z. Lulzim Basha, Alibeaj është plotësisht në përputhje me ligjin. Mundet që deklarata të nënshkruhet edhe nga nënkryetari i Partisë në disa raste të tjera por duhet që organet e tjera të partisë duhet të dorëzonin në Gjykatë vendimmarrjen që ngarkonin një person tjetër. Organet e tjera drejtuese duhet të depozitonin në Gjykatën e Rrethit Gjyqësor Tiranë vendimin që kryetari i Partisë Demokratike ka dhënë dorëheqjen. Si ligji për partitë, ashtu edhe Kodi Zgjedhor nuk e detyrojnë një parti që të zgjedhin kryetarin e ri por një parti mund të vendosë për një organ tjetër që ta zëvendësojë. Organet e tjera drejtuese të Partisë Demokratike kanë pasur një vit kohë për ta bërë diçka të tillë. Vetëm kështu nënkryetari i PD Alibeaj do të ishte kryetar."declared Celibashi.
